@eff Y’all defended, multiple times, a website that targets predominantly LGBTQ+ people and tries to goad said LGBTQ+ people into ending their own lives, and y’all defended it on “free speech” grounds. Stop pretending to be an ally.

@eff You say in your letter “We urge the Committee not to advance the NO FAKES Act in its current form,to examine how existing state and federal law already addresses the legitimate harms the billseeks to address, and to pursue narrowly tailored solutions only where a genuine gap remains.”How about you guys at the EFF and more who signed that letter actually talk about what you want people to be allowed to do in some of your articles? Can you do that? Can the EFF itself write an article that talks about how it would like people & the law do deal with, for example, blatant political propaganda deepfakes of the likes that are discussed in the letter? How does the EFF want people to be able to seek due recompense for the legitimate harms that deepfakes create? Write an article about that.

@eff Bots, Scrapers, Crawlers, & Agents are a bigger threat to the open web than websites & their owners who don’t want their work & art being stolen and don’t want their sites being treated to what are effectively Denial Of Service Attacks at times.How about the EFF goes and talks to artists, hobbyists, & more who’ve had their websites wrecked by endless scraping & bots what they think?

@eff The EFF has a steep hill to climb, in my opinion. -Lots of people are tired of hearing the word “innovation”. Y’all need to explain what you mean when you talk about “innovation”.-A lot of the pieces on the EFF website about AI are tone-deaf. The EFF needs to invite/reach out to artists, programmers, game developers, and website owners and post articles on the main EFF site with interviews with them about stuff like scraping that’s taking down websites, vibe-coding, and more.

@eff I’ve found your articles on AI to be wanting, as well as tone-deaf.-The one article about the IETF trying to combat mass-scraping that is taking websites down/making them slow to a crawl? That was pearl-clutching mainly over the IETF’s actions. The actual main threat to the open web is these scraper bots that are taking websites down and forcing the hands of website-owners to take more restrictive measures regarding who uses their sites, and that article barely touched on that issue!-The multiple articles that amount to telling artists that it *needs* to be fair use for their work to be scooped up into these models, or else the Internet is doomed, are so tone-deaf. @eff Will you write an article about how crawling hurts websites like you mention, and highlight the narrow technical solutions you’d like to see? Or continue to just gesture to the issue and talk about solutions the same way someone else talked about “concepts of a plan”?

@eff Section 230 enabling super-rapid dismissal freezes us out of the ability to move the legal structure forward in a way that enables us to tackle how online tech has developed over the last 30 years. Section 230 has been a part of leading us to this point in time of encrappification, bad actors getting away with hurting people, and more. We also need to stop treating a world without a Section 230 stonewall like it’s going to be a world that’s full of lawsuit-happy maniacs that will sue any website for any reason. The lightning-quick dismissals that Section 230 enables have frozen us out of discussions we could have, as well as the advancement of legal theory and measures that victims of genuine harm could use to seek and attain due justice.
