       Lord Beamish: "I would love to know what the Ministry of Justice has been doing for the last year because it is a very simple thing; nor is it controversial."  Unpopular opinion: it is not at all simple and I have some sympathy with the MoJ in trying to work out what to do.

       @cyberleagle it's entirely possible (nay, probable!) that I'm missing something here, but where is the complication?It doesn't seem, on the face of it, a radical position to suggest that computers aren't infallible.

       @ahnlak @cyberleagle I think that it *is* complicated.There is a rebuttable presumption today, that the output of a computer is correct.As you say, humans, and thus computers, are fallible.Do we change, for instance, to start from the position that the output is unreliable, unless proven correct?That could be done, but I suspect that the impact would be immense, given just how often digital evidence is used. Every PDF, every photo, every computerised record, unreliable unless proven otherwise?

       @neil @ahnlak @cyberleagle personally i think there's a difference between things like well-known standards, popular mass market applications with lots of research done on application behaviour, forensic artifacts etc, on one side, and bespoke systems written for a single customer on the other

       For example, if S.69 were reinstated this would apply not just to the prosecution but to a defendant who wanted to rely on e.g. dashcam footage or a mobile phone video. How would a defendant go about doing that?
