       @Nonilex I can't even begin to imagine what obscure procedural dodge the Supremes are going to pull out of, umm, the air in order to justify reversing this order without reaching the merits of the Fourteenth Amendment issue.  Nevertheless, I'll bet that's exactly what they're going to do.  With their army of graduated-first-in-their-class clerks, they'll be able to come up with something.  It's always easier when  you don't have to worry about being reversed yourself.

       @Nonilex Case number 1:25-cv-23232-XXXX in Florida Southern District, if anyone wants to follow along on Pacer (or Courtlistener, probably).  No filings yet and the "XXXX" indicates that it hasn't been assigned to a judge yet.  Trump is listed as pro se, which means that whatever lawyer is ultimately going to get stiffed for walking into this particular buzz saw hasn't made an appearance yet.

       @Nonilex About damn time, if you ask me.  I've never worked in federal courts, so maybe DOJ actually merits that deference that the judges are now questioning, but I can tell you that local prosecutors in California absolutely don't, but receive it anyway.  I won't say all, but a significant number of California prosecutors think that their job is to get convictions at any cost, and are extremely willing to tell the court "trust us, we represent the People" in order to achieve it.  (They pronounce "People" like that, with the capital P.  You can tell.)  And judges let them get away with it because a sizeable proportion of judges used to be prosecutors.  This whole scenario of "fine upstanding assistant District Attorneys deserve a level of deference that the court would never in a million years grant to sleazy crooked defense counsel" is annoying and insulting, and if it's starting to get chipped away at the federal level, I say hurray.

       @Nonilex Every time I read one of those stories about parents trying to rid libraries of pornographic trash like "And Tango Makes Three," the word "BALLLL - ZAC" goes through my mind.  Someone should sell band instruments to the Moms for Liberty.(Does everybody know the secret trivia item about "Seventy-Six Trombones" and "Good Night, My Someone"?        @Nonilex My guess is that what he means by "non-international" is "not between nations."  Whatever this is certainly isn't between nations, but it's not clear that an "armed conflict" qualifies as a war when it's not between nations, and it's also not clear that both sides of this conflict are armed.

       @Nonilex I suspect that she doesn't stand a chance.  This is happening in Sonoma County, where I live.  The big industry here is agriculture; wine, mostly, and lately cannabis, but basically when the ag industry says jump, everyone else in the county says "how high?"  The ag industry strongly dislikes Ms. Rosenberg.  Maybe her lawyers managed to keep people who felt that way off the jury, but that's pretty tough around here.If I were doing her appeal, one thing I'd focus on is the judge's refusal to instruct on the necessity defense.  The usual example of that is that if you run into a burning building and carry a baby out, that's technically kidnapping but you can defend by saying that you had to do it to save the kid's life.  It seems to me that that's at least arguably available here, and it should have been up to the jury, not the judge, to decide whether it applied.

       @Nonilex I mean, come on, how could they possibly have anticipated that they'd have to disclose the documents to the public and that therefore they should get started right away on redacting victims' names?  Nobody could have seen that coming.  Of course, the guy who's now President specifically promised to disclose them during his campaign, but who takes him seriously, right?  Everybody knows he lies all the time.

       @Nonilex Not the main issue here, but he's saying that now, not having won the Nobel prize, he can "think about what is good and proper for the USA." That compels the conclusion that before the prize was awarded, he was prioritizing winning it over the best interests of his country; that is, that he did things that were NOT good and proper for the USA for the purpose of influencing the Nobel committee.  If he  had acted contrary to the interests of his country in exchange for a personal reward, that would be bribery, which is certainly an impeachable offense; is it any less impeachable if he did it in hopes of receiving a reward that he ended up not receiving?
