#Judges Openly Doubt #USGovernment as #Justice *Misleads* [#lies] & Dodges Orders#DOJ lawyers have long enjoyed a professional benefit when they appear in court. As a general rule, judges tend to take them at their word & assume they are telling the truth. But…as members of the #Trump DOJ have repeatedly misled courts, violated orders & demonized judges…, some jurists have started to show a loss of faith in the people & institution they once believed in most.#law https://www.nytimes.com/2025/08/04/us/politics/trump-justice-department-judges-courts.html?smid=nytcore-ios-share&referringSource=articleShare

The dissolution of these traditional bonds of trust — known in #legal circles as the presumption of regularity — goes well beyond #judges’ use of blunt words — “egregious,” “brazen,” “lawless” — to describe the various parts of #Trump’s #power-grabbing policy agenda.Ultimately, legal experts say, the actions that caused such doubts among judges about the #DOJ & those who represent it could have a more systemic effect & erode the healthy functioning of the #courts.#law #USpol

“I think people don’t fully appreciate how much the ability of the #legal system to work on a daily basis rests on the government’s #credibility,” said Stephen Vladeck, a Georgetown University law professor. “Without that credibility, it’s going to be harder for the #government to do anything in #court — even ordinary things. All of a sudden, you’re going to have #courts second-guessing things that they wouldn’t have before.”#law #USpol #Trump #TrumpLies #judiciary

While it is impossible to know for sure how deeply this #distrust has set in among #judges across the country, a number of judges in recent weeks have openly questioned the fundamental honesty & credibility of #DOJ #lawyers in ways that would have been unthinkable only months ago.#law #USpol #Trump #TrumpLies #judiciary

In June, for instance, an order was unsealed in Federal District Court in Washington showing Magistrate Judge Zia M. Faruqui ripping into prosecutors after they tried to convince him that he needed to be “highly deferential” to their request to keep sealed a search warrant in an ordinary criminal case.“Blind deference to the #government?” Judge Faruqui wrote. “That is no longer a thing. #Trust that has been earned over generations has been lost in weeks.”#law #USpol #Trump #Lies #judiciary

After all, as the judge pointed out, #DOJ #lawyers under #Trump have done much to destroy the confidence normally afforded them in #court. They have fired prosecutors who worked on Trump’s 2 criminal cases, he said. They have attacked the charges brought against the rioters who stormed the Capitol on #Jan6, 2021, as a witch hunt. And they have violated judicial orders in cases stemming from Trump’s #deportation policies & from his efforts to freeze federal grants.#law #USpol #Lies #judiciary

“These norms being broken must have consequences,” Judge Faruqui concluded. “High deference is out; trust but verify is in.”All of this echoed the explosive remarks made from the bench last month by Judge Paula Xinis, who lashed out at the #DOJ during a hearing in the case of #KilmarAbregoGarcia, the immigrant wrongfully deported to El Salvador in March.#law #USpol #Trump #TrumpLies #judiciary

Before the hearing…Judge Xinis had spent weeks trying to get the #DOJ to comply with her orders in the case—& then to answer questions about why they had been flouted in the first place. She finally lost all patience after…the…lawyers failed to give her a straight answer about what the #Trump admin planned to do w/Abrego Garcia after he was brought back from El Salvador….“This has been the process from Day 1,”Judge Xinis said. “You have taken the presumption of regularity &…destroyed it….”#law

…#judges have also questioned the #DOJ’s motives in a handful of politically sensitive cases that officials have sought to dismiss — sometimes against the will of the prosecutors working on them day-to-day.In a sweeping opinion issued in April, Judge Dale E. Ho of Federal District Court in Manhattan rejected as false the reasons the DOJ gave for dismissing #bribery charges against Mayor #EricAdams of New York.#law #USpol #Trump #TrumpLies #judiciary

While Judge Ho ultimately agreed to throw out the charges, he took a swipe at the #DOJ’s #credibility, saying it appeared as though officials had used their #power in a #QuidProQuo with #EricAdams to get him to support #Trump’s #immigration crackdown in the city.#law #USpol #Trump #TrumpLies #judiciary

@Nonilex I still cannot understand why charges of contempt have not been filed. Frequently.

@Nonilex About damn time, if you ask me. I've never worked in federal courts, so maybe DOJ actually merits that deference that the judges are now questioning, but I can tell you that local prosecutors in California absolutely don't, but receive it anyway. I won't say all, but a significant number of California prosecutors think that their job is to get convictions at any cost, and are extremely willing to tell the court "trust us, we represent the People" in order to achieve it. (They pronounce "People" like that, with the capital P. You can tell.) And judges let them get away with it because a sizeable proportion of judges used to be prosecutors. This whole scenario of "fine upstanding assistant District Attorneys deserve a level of deference that the court would never in a million years grant to sleazy crooked defense counsel" is annoying and insulting, and if it's starting to get chipped away at the federal level, I say hurray.

@ianto_jones The issue of enforcement. US Marshals are responsible for enforcing federal court orders, but rather oddly the USMS is an arm of the executive branch, (they really ought to be part of the judicial branch), so Trump could just tell them not to enforce the contempt order / punitive actions. The director & each United States Marshal are appointed by the President of the United States & then confirmed by the Senate.
