       And since we're sharing background: Codeberg has a working group for matters involving Public Relations—some of us are deeply involved with Codeberg's day-to-day operations, others of us have experience in putting words together for projects and group efforts like ours.        @Codeberg I just now was made aware of the ToS changes thanks to the blog post, and I must say that I'm opossed to §2 (1) 1.The way it is written makes it seem like that we need to allow people to commercially use the content, even if we don't want that (And that licenses prohibiting that may not be acceptable by these terms).Of course I may misunderstand this now, but this just shows how vague the writing is, to allow such misunderstanding in the first place.

       @andre_601This requirement is not new and was already there before, because no FSF/OSI allowed license disallows commercial usage of content.What did change is that the following kinds of work can be licensed to disallow commercial use:> As an exception to this requirement, works which primarily describe the personal opinions or experiences of the author, or which embody the unique personal creative spirit of the author, may be included in public repositories under a copyright licence which does not allow modification and/or commercial use, such as a Creative Commons licence with NC or ND restrictions@Codeberg

       @Gusted Well, there still is the issue that the wording, at least for me, makes it sound like as if you have to allow people to use your work for commercial stuff, even if you don't want this.That's my primary issue with this.

       @andre_601 @Gusted Both "free software" (as defined by the FSF) and "open source" (as defined by the OSI) have explicit clauses that don't allow discrimination based on purpose. The FSF has "Freedom 0: The freedom to use the program for any purpose.", including commercial use. And the OSI definition includes "No discrimination between uses, including commercial use".

       @andre_601 @Gusted So far our ToS were based on the FSF & OSI, so the commercial use was already implicitly required by the types of licenses we allowed in the past. The updated ToS have a carve-out under which we accept licenses that explicitly don't allow commercial use.
