#GiftArticleA federal judge’s scathing opinion explains why Trump’s deployment of #troops to #California was more than just an overreach. The #Trump administration broke the #law. Its officials knew they were breaking the law. In its most distilled form, that’s the conclusion of Charles Breyer, the federal judge overseeing a suit brought by #California Governor Gavin Newsom over the #Trump administration’s deployment of National Guardsmen & #Marines in & around #LosAngeles in June. In a scathing opinion delivered today, Breyer said that the administration had acted illegally.https://storage.courtlistener.com/recap/gov.uscourts.cand.450934/gov.uscourts.cand.450934.176.0_1.pdf#law #MilitaryState #PosseComitatusAct #authoritarianism #tyranny #autocracy #Gestapo #NationalGuard #USTroops #resist

Deploying these service members “for the purpose of establishing a #military presence there & enforcing federal law,” Breyer wrote, “is a serious violation of the #PosseComitatusAct.” That #law, passed in 1878, bars the use of the military in domestic law enforcement, except as allowed by the #Constitution or by #Congress.Breyer’s ruling makes plain how the admin worked to circumvent the law, & why.#Trump #MilitaryState #authoritarianism #tyranny #autocracy #Gestapo #NationalGuard #Marines

The people of the #US have been wary of the use of #military to enforce laws in the country since before the nation’s founding; the presence of British troops was a spur to rebellion. The #Constitution grants only #Congress the right to call “forth the Militia to execute the Laws of the Union,” although some delegates would have preferred not to allow that…. But it has been presidents who are more apt to use the military for law enforcement, & Congress has worked to limit their ability to do so…

@Nonilex I feel like nothing short of arrest warrants issued against those who made the illegal orders will actually punt a dent in this. Project 2025 knew what it was doing with this and it's working all too well since Republicans decided Trump is above the law.

@Nonilex Don't worry. The Roberts court will overrule. It's not illegal if their guy does it. #epstein #kompromat #krasnov

@Nonilex When all this is done, and we get reasonable leadership, we need those leaders to ignore the Supreme Court ruling on presidential immunity and arrest Trump and co. for these crimes. If the court wants to argue against the contradictions of their own ruling to try and stop the arrests let them.
