Hey Canadians:I just heard about two Canadian friends of a friend who were driving into the USthe border agents demanded they unlock their phones; the agents searched the phones, found anti-Trump stuff on one ...... then confiscated that phone and neither person was allowed into the USThese folks weren't activists or anything -- the search doesn't appear to have been triggered by thatso, govern yourselves accordingly

@angiebabyMay I suggest to also disconnect iCloud/Google. This means to create a dummy iCloud or Gmail account to make the cellphone work, and once safe (crossing πΊπΈ border) use the cloud to access your _real_ data, that would prevent CBP agents to link your persona with anything that may be tied and accessible from the phone: gmail, maps, documents, photos, etc. If you are not targeted person you would be fine, tho.

@clive It's awkward when such triggering stories don't come with names or any other specifics.

@clive How about "which state"? CBC today has a story of two musician sisters being harassed at length by Ohio police, and the Ohio police calling the complaint 'hate mongering'.https://www.cbc.ca/player/play/video/9.6694117I'm just wondering if we can start mapping which US States have serving MAGA cops actively promoting their politics.

@RoyBrander alas, my friend doesn't want any identifying info out therepersonally I'd regard every state as suspect -- the border guards are federalized and thus not responsive to the relative merits of any given state's local governance

@clive @RoyBrander i havae to think this was the border guard's personal choice, and highly illegal. but, the US is not a place of law and order, and th federal government, nor the political parties can be trusted, on any level, concerning anything.

@gaian @clive @RoyBrander IANAL, but my understanding is that it is not illegal for border guards to demand access to devices of non-citizens, and they also claim the right to do it to US citizens. (The latter is contested).

@rwg @gaian @clive @RoyBrander Sound point regarding physical access, although I suspect the legality of compelling someone to unlock their device with a passcode may be up for debate. For anyone anticipating such an event, I believe GrapheneOS has a "duress" feature (where entering an assigned "duress" pin code to the device wipes it), and - although I've not tried it - there are apps that do something similar.https://f-droid.org/packages/me.lucky.duress/*edited to add: being logged in as a guest user with a token set of contacts and messages and whatnot is probably the other easy win, although if they're smart enough to notice it may make them grumpy. Some companies advise travellers to fly to specific countries with burner devices, and the company agent gives you a new device when you land. This is usually for the sort of country that will install snooping software on your device when given access (or worse). It is unlikely to become one of those situations.#law #tourism #grapheneos #android #security #policing

@BuckRogers1965 The burner laptop is a smart idea -- I got one for travel to, irony of ironies, China I saw some discussion on Facebook that having a burner phone with no social apps on it could be a double edged sword -- nothing to see, but extra suspicious because there's nothing to see

@HeliosPi @clive years ago, I was stopped near the southern border of Vermont, in one of those gulches that the highway runs through with cliffs on both sides. I got the border guards to let me open the trunk to get the passports out. They spent a long, long time looking at the passports before saying that they didn't know how to read my visa.I ended up tutoring them on which parts to look for and how to interpret them. They apologised and blamed Canada for letting in terrorists.

@HeliosPi @clive I was once stopped in Amsterdam on my way back to the US and told that I didn't have a visa. It turned out that the person doing the visa inspections, and then his supervisor, had no idea that he needed to ask for a different document β the one that DID contain my visa.I got the impression that there isn't a lot of expertise in the system. But the meanest grilling I got was over my greencard! WHERE DID YOU GET IT FROM? HOW DID YOU GET THIS? Um... I sent application forms....?

@clive @HeliosPi I don't want to brand them all as mean. I was once eyed up by a passport control officer at LAX long before I got to the end of the queue. He kept asking increasingly precise questions about where I'd studied and lived. Eventually a huge grin broke out and he yelled "I KNEW IT I KNEW IT! I KNEW IT THE MOMENT I SAW YOU!"I had lived for a couple of years on the same street where he grew up, and was the first hometown bro' he'd seen since being posted to LAX. He needed that.

@clive This is true.Customs and Border Protection (CBP) has more rights to search and seizure than local US police. Know the existing US laws, which allow this.Pay attention to the current administration's overstepping of those laws.https://www.theverge.com/policy/634264/customs-border-protection-search-phone-airport-rightsReconsider travel accordingly. Burner phones are still available.https://www.theverge.com/policy/634264/customs-border-protection-search-phone-airport-rights

@clive A.) I believe this 100%.B.) This administration, and affiliated law enforcement, have continuing education to remind their staff that noncitizens do not have the right to free speech, at all, at the borders, and even in this country. A whole chunk of law is dedicated to clarifying that noncitizens have no rights in the US, including due process, and search and seizure.C.) This was a stupid mistake by the supreme court - elevating rights to special privileges only held by citizens.

@Urban_Hermit @clive B contains an inaccuracy. Non-citizens absolutely have a Constitutionally guaranteed right to due process in the US.Amendment IV: "The right of the people"Amendment V: "No person"These are two very, very different things.

@clive I would like to suggest that anyone who is a victim of this kind of confiscation, is to call of your service provider and have the phone bricked immediately. I know phones generally have this service only but..Their personal data may or may not have been completely scraped out of that phone, and it doesnβt hurt, especially if you assume that they would be selling the device and its data for pocket money

@HeliosPi @libroraptor @clive But one does have to question the morals of someone willing to operate under such a system.
