I remember hearing somewhere that the reason why Nintendo's so gung-ho about emulation is that they view their older titles as competition against their new ones. That seems like a common-enough view across the industry. It's not enough for game monopolists to attack fangames and original titles with patented mechanics; they want to control the past.#intellectualpropertyisthefthttps://www.gamesradar.com/games/publishers-are-absolutely-terrified-preserved-video-games-would-be-used-for-recreational-purposes-so-the-us-copyright-office-has-struck-down-a-major-effort-for-game-preservation/

"Market harm" is also a hell of a term to use here. To a corporation, all competition is market harm. Never mind the real market harm of the government telling individuals on behalf of corpos what games they can or can't enjoy, or what means of distribution they use, through IP law. If corpos and their lobbyists want to stop this so-called market harm they should make better games and provide easy ways to access all of their old titles.
