Netzpolitik leaks 3 new cables:https://netzpolitik.org/2023/etappensieg-verpflichtende-chatkontrolle-vorerst-gescheitert/The most important thing is a quote from the presidency, taken from a session of the Law Enforcement Working Party Session on 2023-12-01 (translated to English from German):"The presidency concluded that the Council is not ready to take up negotiations with Parliament. It's more important to extend the temporary derogation to prevent a legal gap".Thread: 1/4#chatcontrol #Chatkontrolle

Since the EU Council is unable to negotiate now, it seems unlikely that the proposal will still pass during the legislative period! And who knows what things will look like after the next elections...Apart from the LEWP session, another cable documents the public session of the Justice and Home Affairs Council in 2023-12-05, I also wrote about it here: https://chaos.social/@maxim/1115284536536767802/4

The third cable documents another session of the council (this time not public) on 2023-12-06 which discussed the extension of the temporary derogation. The Commission noted that this extension is necessary, as after the elections the European Parliament won't realistically be able enter trilogue negoitiations until October 2024. While the reasons vary, member states seem to be willing to accept the extension.3/4

So it looks like we mostly won for now: Chatcontrol won't pass this legislative period. However, it's very likely the temporary derogation is going to be extended, which means companies can continue to scan messages voluntarily. Additionally, it's clear this isn't over yet: The proposal will be back. We may have won this battle, but the war on encryption keeps going. Let's keep fighting!4/4
