       Since the EU Council is unable to negotiate now, it seems unlikely that the proposal will still pass during the legislative period!        The third cable documents another session of the council (this time not public) on 2023-12-06 which discussed the extension of the temporary derogation.The Commission noted that this extension is necessary, as after the elections the European Parliament won't realistically be able enter trilogue negoitiations until October 2024. While the reasons vary, member states seem to be willing to accept the extension.3/4

       So it looks like we mostly won for now: Chatcontrol won't pass this legislative period. However, it's very likely the temporary derogation is going to be extended, which means companies can continue to scan messages voluntarily. Additionally, it's clear this isn't over yet: The proposal will be back. We may have won this battle, but the war on encryption keeps going. Let's keep fighting!4/4

       The hungarian  presidency seems to try to force the issue of getting chatcontrol to pass in the council. Hungary has changed the point of today's agenda to having a mandate to negotiate.
