A few thoughts about Trump's latest unhinged rants. He really wanted this case to be about his First Amendment rights. The DOJ sidestepped that in the indictment. Apparently Trump attorney John Lauro is on Sunday talk shows espousing a free speech defense. Meanwhile, Trump is posting unhinged rants that he can argue fall within his free speech rights. (He can offer opinions, etc. What he can't do is disseminate confidential grand jury material.)Given Lauro is out there trying to turn Trump's indictment into a First Amendment issue, I believe that the "legal strategy" right now is to try to turn this into a case about freedom of speech.2/

Let me tell you how smart this is.It's been a few years now, so people are forgetting how Trump controls the national narrative. He doesn't want people talking about the evidence that he intentionally overturned the election.So he will go on Truth Social and post things that are inflammatory but not illegal.Many of his critics will take the bait and start shouting: LOCK HIM UP LOCK HIM UP (over his social media posts.)This becomes all anyone talks about.3/

This ploy only works because social media is a rage-generating machine.If you picked up the newspaper once each day, or twice each day, this ploy would not work.But everyone has to chase the latest shiny thing.So Trump puts out a shiny thing, which is no different from what he has been doing for years, and everyone chases the shiny thing as if it is somehow brand new.And they stopped talking about what matters: An indictment to overturn the election.4/

Trump is putting his political needs ahead of his need as a criminal defendant.This is not stupid because his only hope right now is to keep his grip on the Republican Party.Adding: The DOJ took care not to indict him as a two-bit bullying thug. We have known that about Trump for years and he has a huge following because people like bullies.The DOJ wants this to be about an illegal attempt to overturn the election. That's where the focus should stay.5/

@Teri_Kanefield: Maybe not stupid, but it will be interesting to see when and how he steps over the line and does something criminal that brings further restrictions such as relinquishing his passport, confinement, fines, etc., or spawns entirely new indictments on top of the ones he's already under. He's pretty good at making threats that his supporters react to but give him "plausible deniability" that he wasn't making a direct threat even when he was. He's got that mob boss thing down, but he's also really pissing off the government which will bite him at trial. It'll be interesting to see how the rulings go when there could be leniency but doesn't have to be, he's pretty much quashed any favor there.

@goodreedAJ this is spot on. Team #Trump injects his narrative into social media following his violation of his pretrial conditions. (See highlighted text) The #TruthSocial post is evidence of his violation. Their excuse is weak, but it is being pushed for the public, who are NOT aware of what the conditions are. NOTE how his people pushed this false definition for the public. (I broke it up so I won't act as data mules on his message as @emptywheel suggests we do.) @Teri_Kanefield

@JStatePost That's my thinking, but it will frustrate people because the DOJ has to wait until he actually breaks a law.People will shout "Lock him UP!" every time he says something they think he shouldn't say.

@Teri_Kanefield @JStatePost attempting to intimidate or sway a witness is a direct violation of his release agreement. His legal team might have been able to conjure up plausible deniability for one of his social media posts, but the one targeting Pence is going to be hard to sweep under the rug. That said, heās flaunted the rules twice in two days; if the prosecution thinks heās just under that line, give him another couple of days. Heāll get there.

@mjf_pro @Teri_Kanefield @JStatePost probably, yeah, given how thoroughly heās torpedoed every defense he could possibly raise in the classified documents case by popping off at the mouth, if Iām the prosecution, Iām happy to sit back and let him talk all he wants as long as he doesnāt let that rise to witness tampering. Heās getting dangerously close to that threshold (Iād argue over, but Iām #NotALawyer )
