It' been a few hours now, and I've heard nothing from the Biden administration. Forgive me if I missed a response, but FFS do something!

@SrRochardBunson @lednabm #StudentLoanForgiveness is being framed wrong. Instead of saying 'loan forgiveness', it should be 'interest forgiveness'. I have paid back more than the amount I borrowed, and even if I were to get the full $20k, I would still have paid back more than I borrowed. No one should be making money off of loans to students, especially if those loans can't be discharged in bankruptcy. Reframe it as #InterestForgiveness and change future #StudentLoans to be #InterestFree.

@BobRobertsonXI @SrRochardBunson @lednabm Huh. Tempted to see what the strong "religious values" types feel about framing the forgiveness of Student Loan Interest as an "Anti-Usary" bill...

@jrconlin @BobRobertsonXI @SrRochardBunson @lednabm I would simply create a case to challenge the Religious Freedom Restoration Act as a violation of the Equal Protection Clause of the 14th Amendment. And wait for the Supremes to try to untangle that mess. And remember, venue shopping is your friend...

@toxtethogrady @jrconlin @BobRobertsonXI @SrRochardBunson @lednabm This court wouldn’t bother untangling anything. They would simply vote against it like the legislators they are

@gneilyo @jrconlin @BobRobertsonXI @SrRochardBunson @lednabm But it's going to take some time. Rendering people who discriminate on the basis of their religious beliefs unable to claim protected status and thus subject to enforcement actions for civil rights violations. And the Supremes need to be careful how they legislate, because the Law of Unintended Consequences was not repealed by their actions yesterday...

@toxtethogrady @gneilyo @jrconlin @BobRobertsonXI @SrRochardBunson @lednabm That is the point (to them)... this means (in the short term) they can keep doing things to get their way...But long term it is going to suck hard...🤔

@gneilyo @jrconlin @BobRobertsonXI @SrRochardBunson @lednabm The other great thing about the termination of precedent is that it forces the Supreme Court to rule on the same issues again and again every time one litigant brings another to court. They can't look at how they ruled in previous cases, because precedent is now subject to being overruled. So not only is there the tedium of having to reargue issues already settled, but there is always the chance that litigants presenting the same set of facts to the same court could get different outcomes. How's that for a can of worms?

@Aviva_Gary @gneilyo @jrconlin @BobRobertsonXI @SrRochardBunson @lednabm The approach that everyone on the Federal bench should be adopting for the foreseeable future (based on precedents last year and this) is that each new case presented to them should be decided on its own merits and the laws on the books (as interpreted by each individual judge). In other words, no judge on the bench should feel bound by precedent (to quote Robert Bork) and should rule as they interpret the law. Meaning the decisions rendered yesterday and today by the Court only apply to those cases specifically, and not to anything subsequent. This is going to be so much fun...🤔
