@lauren Since Constitutional amendments don't get turned off and on, the 14th Amendment comes pre-invoked as of 1868. All that needs to be done is to comply with its provisions.

@TruthSandwich That's not true. There are clearly some decisions that show a definite hardcore originalist stance on key constitutional issues. Again, the ruling I mentioned was an enormous win for free speech when it would have been easy to rule the other way.
