       People are asking me about appeals.Take out your notebooks. It is time for Appellate Law 101.A trial court does two things: It applies the law and it finds the facts.Generally the jury finds the facts and a judge then directs with applying the law.Appellate courts are not fact finders. You don't get a new trial on appeal.When appellate courts review the factual finding of a lower court decision, they look to see if sufficient evidence exists to support the jury findings . . .1/

       This is a low standard. To win on appeal, you basically have to show there was nothing to support the jury's finding. Only when I was desperate and had nothing else did I raise on an appeal the issue that "insufficient evidence supported the lower court's finding." And I had to make sure it wasn't frivolous.Appellate courts mostly look to see if the trial court correctly applied the law or made errors that were so prejudicial to the defendant that a fair trial wasn't possible.2/

       Lower courts have lots of discretion. At least in California, to win on appeal you not only have to show that the lower court screwed up, you have to persuade the appellate court that the error actually harmed the defendant.Appealing does not mean that in the meantime the defendant didn't lose. Trump lost. If he appeals he still lost.Often a win on appeal just means you get a new trial, which means Trump would have to go through the whole thing again and likely get the same result.3/

       @Teri_Kanefield I am not a legal expert, but the fact that the jury took such a short time to reach their verdict, suggests that the evidence against trump was very powerful.

       @Teri_Kanefield does Trump need to put up an Appeal Bond?  If I understand correctly, it could be as much as the judgement.  Appealing wont help him if he does not win and the money is tied up during appeal.
