My view of the conversations around the Rust Foundation's draft Trademark Policy is:- most people don't know how TM law works- some people seem to believe there's a "Rust Foundation co." swimming in cash twisting mustaches trying to be evil- a lot of people seem to believe that the draft was meant to be a "final comment" process when it was instead a "first public draft"- some people have a vested interest in taking the most outrageous interpretation of the draft- the draft needs more work

The main issue I see is that people that feel invested in the Rust project are 1) not lawyers (legalese is a different language that you have to learn to read) and 2) used to an open process where comments can be publicly made available.

You can have a PR with any drive by comment from anyone who cares to pay attention. If changes are quickly needed, they can "just be done" by the original author or another contributor. Legal documents don't work that way. You can't have a globally editable document that anyone can modify (small changes in wording can have huge consequences, in isolation or when interacting with other sentences). You have to have a lawyer in the loop.

I'm super disappointed on how a small, loud group of people have been abusive towards individuals in this conversation, particularly those that are upset at willful misreadings of the draft. I disagree with parts of the policy, but yelling at people that they aren't listening at the community, when this is precisely to gather feedback, feels incredibly discouraging and honestly makes me want to walk away, and I am not even in the receiving end. Can't imagine how those who are are feeling.
