It is hard to keep up with the bills emerging from state legislatures. It seems so-called “red” states are competing for the most “freedom-loving” state (please note the sarcasm) by curtailing the rights of such groups as women, voters, teachers, historians, drag queens and, well, anyone who reads. States didn’t suddenly transform; it has been a 50 year carefully mapped journey to get to this point. And control of state legislatures is the whole ballgame. Follow along. 1/#democracy #politics

@jackiegardina So what is accomplished by turning ordinary citizens into criminals with the host of new laws? And I don’t think anybody believes the new laws will change personal behavior, right? So so what’s the side effect of making so many people criminals?

In 1971, Lewis Powell drafted a memorandum describing what the GOP & business interests needed to do to obtain power and suppress dissent. Powell identified several “disquieting voices” that needed to be curtailed: college campuses, churches, media, and minorities. The memo also highlighted the judiciary as an important ally. 2/ https://biotech.law.lsu.edu/blog/powell-memo.pdf#democracy #politics #law #lawfedi

In 1973, the American Legislative Exchange or ALEC was born. ALEC has been the primary source for model bills introduced in multiple states. Between 2010 and 2018, ALEC model bills were introduced nearly 2900x in all 50 states with more than 600 becoming law. Remember Trayvon Martin, George Zimmerman, and the Stand Your Ground Law. That was ALEC. 3/ https://www.usatoday.com/story/news/investigations/2019/04/03/alec-american-legislative-exchange-council-model-bills-republican-conservative-devos-gingrich/3162357002/#democracy #politics #lawfedi

Over the last 50 years, party control of state legislatures has switched from Democratic to GOP. And with that control comes the ability to draw district maps and to dictate voting rights. And with the control of redistricting comes control of Congress. It was the plan all along, as laid out by Karl Rove in the Wall Street Journal. 4/ https://www.wbur.org/hereandnow/2016/07/19/gerrymandering-republicans-redmap#democracy #politics #lawfedi

We decided to launch SideBar during the election because we wanted people to understand the importance of STATE #elections. The #media was focused on control of Congress, but the real battle was at the state level. Our first guest, David Pepper, had been screaming this from his Whiteboard on Twitter and his book Laboratories of Autocracy that used his beloved state of Ohio as an example of so-called competitive autocracy. 5/ https://legaltalknetwork.com/podcasts/sidebar/2022/11/its-the-statehouses-stupid/#democracy #politics #lawfedi #podcast

David Pepper didn’t just describe the problem, he offered solutions. He described those solutions in the second episode “Reclaiming Democracy.” In the end, we are all responsible for standing up for democracy—not on Twitter or Mastodon or Post or Spoutible—but in our communities. 6/ https://legaltalknetwork.com/podcasts/sidebar/2022/11/reclaiming-democracy/#democracy #politics #podcast #lawfedi

David Noll provided insights into the real-world impacts of these state laws. States are passing laws that provide citizens the ability to sue librarians for the books in libraries and teachers for what is said in classrooms. Noll and his coauthor aptly described these laws as Vigilante Federalism, a Jim Crow 2.0. 7/https://legaltalknetwork.com/podcasts/sidebar/2022/12/vigilante-federalism-with-david-noll/ #democracy #politics #lawfedi

Suzanne Nossel, CEO of PenAmerica, discussed the dangers of book bans and educational gag orders. These bills are not coming from organic, grassroots efforts within each state. They come from well-funded, national organizations like Moms for Liberty. And these bills represent a minority view—over 70% of parents are comfortable with the curriculum in their children’s schools. 8/ https://legaltalknetwork.com/podcasts/sidebar/2023/02/book-bans-and-democracy-can-they-coexist-2/#politics #democracy #lawfedi #books

Buffy Wicks provided an insider, and quite honestly, a much more hopeful view of state power. Wicks came to national attention during the pandemic when she was forced to bring her infant to statehouse floor to vote on legislation. She discussed the importance of representation in state legislatures and how critical state legislatures were to protecting fundamental rights. 9/ https://legaltalknetwork.com/podcasts/sidebar/2023/02/who-do-state-legislatures-actually-represent-with-buffy-wicks/#democracy #politics #elections #lawfedi

On Tuesday, SideBarLTN publishes our interview with Joel Rogers, who among many accolades has been identified as “one of the 100 living Americans to most likely shape U.S. politics and culture in the 21st century.” He will discuss the rise of ALEC and how we can successfully combat it with irony and guile. Despite his years battling the right, he actually provides a very hopeful message. I hope you will listen.https://legaltalknetwork.com/podcasts/sidebar/#democracy #politics #lawfedi

@Onlineadviser you should look back at Nazi Germany. They criminalized any behavior that they perceived as deviant, including sexual deviants. Criminal laws was how Nazis controlled the resistance.

@jackiegardina Here in my home state of New Jersey we have a high percentage engaged in criminal behavior. We endure a high level of government prosecutions. Our powerful prosecutors enjoy a n unlimited budget. However, we see almost nobody adjusting their behavior because of the law. Contrast this established pattern of law defying behavior to red states where teachers and corporations changed their behavior because their state law changed. Could New Jersey turn into Nazi Germany? It is tough for me to imagine.

@Onlineadviser Nazi Germany criminalized a host of ordinary behaviors other than being Jewish to remove so-called deviants from society. They also used public shaming to ensure compliance, literally parading the disgraced through the streets to be ridiculed. We do that on social media now. Threatening someone with the loss of their job and future employment is even more insidious than criminalizing. A teacher with a felony conviction is unlikely to be hire as a teacher again.

@Onlineadviser @jackiegardina In many states, if you can pin a felony on someone, boom! Now they can’t vote.
