#DefamationLaw #FunReadingLegalDocuments Here is Dominion's latest filing in the Fox defamation lawsuit: https://www.docdroid.net/sIIip3S/rupertmurdochdepo-pdfSo far the basic allegation (based on deposition of Fox executives) is that executives at all levels of Fox "knowingly opened the airwaves to false conspiracy theories about Dominion." (Screenshot #1)We start with snippets of Rupert Murdoch admitting that Fox commentators told (and endorsed) lies (and he knew they were lies) #2 and #3But then . . .1/

. . . to show how chummy Rupert was with the Trump team, and to contrast the fact that he didn't like the fact that Trump was refusing to concede the election and insisted on lying, we get this stunning clip:"During Trump's campaign, Rupert provided Kushner with confidential information about Biden's ads, along with debate strategy."Me: "Wait, what?"Debate strategy? Telling Kushner?Well, wow. I haven't gotten to the end notes, but apparently that's from Rupert's deposition.2/

Rupert also admitted that Carlson was “wrong” to repeat Mike Lindell’s stole election lies if Carlson didn’t contest it."Viet Dinh, the highest ranking lawyer in the Fox corporate structure admitted that if people in the chain of command who had power to exercise control over the shows knew the allegations were false, they had an obligation to stop it."Backing up, this is Dominion's opposition to Fox's motion for summary judgment,For what that means, see: https://law-and-politics.online/@Teri_Kanefield/1098811448531681183/

@Teri_Kanefield If Fox News hosts endorsed a lie that the network itself didn’t, you’d think these folks would have been terminated. But, no, they’re still tucked snugly into bed with their boss/employer. Swing and a miss, Rupert.

@Teri_Kanefield “My friend… called me” This is the problem. This is what happens when we, the ‘people’ get caught out watching the players instead of the ball. This line of communication, given each player’s position/role/power, is simply outrageous and reeks of apprehended, if not actual bias.

The reason for quoting Murdoch saying that commentators weren't supposed to lie was to debunk Fox's arguments in the last brief that they were "neutrally" reporting what was "newsworthy," namely a sitting president alleging election fraud. In fact, this filing shows the Fox top people in WTF mode as Trump insisted on lying and their executives insisted on repeating the lies. 4/

Right after the election, Rupert called Mitch McConnell and sort of admitted (he said it was "probably true") that indeed he urged McConnell to ask other senior GOP officials not to endorse Trump's election lies. (#1)Murdoch, trying to prevent a destructive forest fire and failing. On election night, they knew they'd get hit "hard from the right" for calling the election for Biden after Arizona. Then, when the backlash keeps getting worse, the top executives worry about backlash and losing viewers to Newsman, so they change their strategy. They were also monitoring CNN reporting that Fox was enabling Trump's election denial. So they were caught in the middle: Not rightwing enough to keep up with Newsman but still getting criticized for enabling lies. They settled on their strategy: Go forward with the lies and phrase it as reporting the news, even though they knew it wasn't.8/

Okay, we're back. Happy dog, happy life.Murdoch acknowledged that the news commentators lied, but insisted Fox News Network itself endorse the lie (the legal issue Is whether executives are responsible for what newscaster say). Dominion responds with the law: Anyone who participated is responsible, and asserts that everyone in the chain of command "participated" because they knew it was wrong and they had the authority to stop it. 9/

I like this part: Murdoch says "in hindsight" he would have liked Fox to be stronger in denouncing the lies. (#1)Funny how a $1.6 billion lawsuit plus punitive can improve a person's hindsight.More legal argument: Fox accuses Newsmax of taking an extreme view of the law.Newsmax accuses Fox of trying to change the law to allow lying with impunity. The law is from New York Times v. Sullivan."Enough with the facts! Let's get to the law" says law nerds everywhere."10/

The law is from New York Times v. Sullivan, which I talked about here:https://law-and-politics.online/@Teri_Kanefield/109881097362025815I don't like to make predictions because courts tend to be unpredictable, but we're in the summary judgment phase, so here's my prediction:Fox will lose on its motion for summary judgement and Dominion may just win on a partial summary judgement (they want the court to acknowledge that the election lies were lies so they don't have to take time proving that in court.11/

@Teri_Kanefield he could have ordered those fools to stop spreading the lies but apparently, he didn't do that. Instead, he puts all the burden on them, essentially throwing them under the bus instead of taking responsibility as well.

@Teri_Kanefield civil pursuit for penalties are just a disguise for wealthy elite to buy their way out of the criminal penalties they richly deserve. He should have been in jail so fast, for so long that any future corrupt creature of the same sort would think twice. The debate over civil consequences makes me so sick when it ignores the threat these individuals pose to whole societies. If corruption resided in a septic tank, Murdoch is would be looking up at you if you slid the cover off
