A question for #privacy #lawprofs & #lawyers: Can a private company that collects and retains customer data require the customer to pay for security? It appears that the bird site is removing 2-factor authentication from any user who does not pay a subscription fee. It seems like this is like a hotel saying that we used to have deadbolts on our doors but now we only provide them to our diamond members. Am I misunderstanding the burden?#law #lawyers #lawfedi

@jackiegardina People on the birdsite are joking that next Tesla will offer brakes to subscribers to Tesla Blue.

@Teri_Kanefield That seems an appropriate analogy.

@jackiegardina This is completely out of my area of expertise, but I don't know if hotels have a duty to provide security, but they probably have a duty to warn that there is none: "Stay in our hotel and your door will have no lock."I don't know if no lock is like a slippery puddle on the floor.Calling all Torts Lawyers.

@Teri_Kanefield I have no expertise either but like most attorneys I can feign expertise on most topics. Calling all Torts Lawyers.

@Teri_Kanefield @jackiegardina Not a torts lawyer either (property prof, so slightly relevant) but if a landlord provided no locks, I'm pretty sure they'd be liable for thefts and assaults that resulted, even tenants had the option of paying extra to get a decent lock.

@Bethanyrberger @jackiegardina That sounds right, particularly if the locks were there when they moved in, then the locks were removed (as with Twitter accounts).
