There has to be a clear threat of homicidal or suicidal ideation and if there is, most holds are capped at 2-3 days and need to be approved by a judge.Kayne could go either way because his behavior is certainly bizarre, but it's not clear he's actually a threat and any move against him would attract scrutiny.
