For those that don’t know, Miller v. Bonta challenges California’s assault weapon statutes. The history of this case is as follows. District Court Judge Roger Benitez issued a decision that said California’s assault weapon laws were REPUGNANTLY unconstitutional. However, with politically significant cases such as this, it’s common to issue a stay on any ruling that upends the status quo.

Judge Benitez issued a temporary stay on his ruling, allowing California to seek a permanent stay at the 9th Circuit. Miller was heard by a three judge panel at the 9th circuit, who upheld Benitez’s ruling!! California’s gun laws were going to be struck down.

Well, California didn’t like that, so they asked for an En Banc rehearing of the case by the 9th circuit. There were enough leftists on the En Banc panel to reverse the decision of the 3 judge panel and save California’s assault weapon laws from certain death.

After NYSRPA v. Bruen, interest balancing was held by the Supreme Court to be an unacceptable way to hear 2A cases. SCOTUS turned the tables with this opinion. Now, States must find a historical analog to the law they want to defend that was in place at the time of the nation’s founding. Not only that, the law had to be common across most of the 13 states.In practice, this makes almost all modern gun control indefensible in court. Even the NFA is in grave peril.

This summer, plaintiffs requested that the permanent stay issued by the 9th circuit be lifted. This would allow citizens to buy, sell, and possess firearms that California calls assault weapons.

California wasn’t having any of that. They asked that the 9th vacate Judge Benitez’s decision and requested a do-over of the case from square one. Their argument was, “we didn’t argue this case on the new instructions from SCOTUS, so we should be able to start this over again.”The 9th circuit agreed.

The En Banc panel balanced the interests of public safety with the interests of individual liberty. This process is called “interest balancing” and in practice, can be twisted to always come out in favor of California at the expense of the citizen.

Now, California AG Rob Bonta expected that this move would buy him time. Remember, the only card California can play is to stall. He expected that he’d have at least 12-18 months before he’d have to argue this case at the district court, and then another six months for Judge Benitez to issue another decision.He is hoping that Biden can flip SCOTUS in that time, and if California had to argue Miller at SCOTUS, they could win.

This tells me that Judge Benitez had this order ready and waiting for the State to try this crap. Based on what I’ve seen and read from Judge Benitez, he’s SICK AND TIRED of this utter H0R$E$H!T from California and the 9th - AND HE’S GOING TO DO SOMETHING ABOUT IT.

It’s funny. In a press conference after Judge Benitez’s decision came out, Governor Newsom arrogantly claimed that this lawsuit was the work of the gun lobby, that California respects the second amendment, and that gun owners have no problem with assault weapon bans. Well California doesn’t, and gun owners have SERIOUS problems with these laws - and we’re ready for a HUGE FIGHT in court.AG Bonta is going to have a very hard time in court.Good luck…END
