I just got an email asking me about how I'd respond to CCPA requests for #FreeRadical users (complete with a passive-aggressive deadline for responding). My open response:1) The CCPA and GDPR don't apply to us.2) Feel free to download your data at any time.3) We honor deletion requests.4) We log nothing other than what the Mastodon app logs to be able to provide services.Our privacy controls are stronger than what CCPA or GDPR require, which would be good if we were subject to them.

(While I really like the GDPR, we're based 100% in the US and EU law doesn't apply. I mean, I know they claim it does, but I'm worried about violating a EU law about as much as someone in Romania cares about violating a US law. I bet lots of other countries think their laws would apply to me, but I'm happily ignoring them, too.Again, I'm anti-GDPR and wholly support its stated goals. You're never going to see one of those dumb cookie notices here, though.)

@packetcat Yep, that's the one! I just forwarded it to abuse@amazon.com with the message:"I received this email today. Note that nothing I do is even remotely covered by the CCPA, and this contains an implied legal threat at the end. After posting this on social media, several friends replied that they’d received the same email.I believe this is being sent as part of a scam to trick people into paying fines for a CCPA violation or something like that."

@lanodan @tek IIRC it's not just logins that are exempt, but any cookie which exists solely for the function of the website and not for tracking purposes.

@tek That's not how it works. The fact that your service is accessible from the EU is enough to subject you to the GDPR. You may be not worried about it but it does apply nevertheless, the same way that a lot of US laws applies to the rest of the world. If you are not in compliance, nobody will do anything, but it's used in this way against Facebook, Google and others.

@thomas FAANG have offices in EU. I'm well aware that the GDPR says that anyone who handles EU information is subject, but as a practical matter, nah.What US laws (not treaties, but internal laws) apply to non-Americans elsewhere? There are so many countries that would like to enforce their local laws remotely, but absent a treaty with the US gov't, I'm not subject to them, either.

@thomas The laws you link affect US people and companies and prevent them from making financial transactions with certain foreign entities. They don’t, and can’t block someone in England mailing money to someone in Cuba, for example. That would require a treaty between the US and England that obligates England to enforce that law.Blog aside, EU has no authority whatsoever to enforce their laws against someone entirely outside the EU.

@tek @lyrabon I haven't had this discussion with anyone yet, so I am finding it interesting.It's nice to know my initial look in to GDPR did get me enough info to know I don't have to worry about it so much at the moment. Something similar comes up in North America, I'll be paying closer attention.Sounds like you've had this convo a few times, though.

@kinetix @lyrabon In California, you do have the CCPA to deal with, but that only applies to for-profit companies, and then only to ones above a certain size.Yeah, it does come up more than I'd expect. It's a little ironic to me that if I told someone that US law applied to them in Europe, people would shout at me for being a "typical American" or such. If I say EU law doesn't apply to me, yep, "typical American".(This chat didn't go that way. Others have.)
