The MPA's argument isn't even legally sound. Their argument is that the source code facilitates "copyright infringement" because it is a home for development of the nyaa.si torrent tracker. The source code on is not illegal though, which is what they took down.If you're going to file completely fraudulent DMCA takedown requests that is supposed to be illegal (unlike the source code). Not only that but I do not believe your information should be hidden from public view as it is on this notice.

Something else to note is that the website itself is operating perfectly fine still.Of course it is, they took down the public source code, not the website.I'm not sure how much more bird-brained you could be.

@ilja Maybe they will. GitHub is required to comply with the request under US law either way (if they want to go through the "proper" legal process).nyaa.si is an interesting target though, and I would assume it was tactically chosen by the MPA. The source code is completely legal but the developers use it for purposes that are illegal where GitHub is hosted. Call me conspiratorial but I don't think that this was a coincidence.

@jang The request is required to pass. The DMCA is written that way. If a provider ignores a DMCA takedown request they lose their safe harbor provisions. The law is written with the mentality of "guilty until proven innocent" which is why abuse of the DMCA is so flagrant. There is no due process for the accused party.

@polarisfm @jang there technically is, the order is made under penalty of perjury so you can take the claimant to court over a bad faith claim. but that involves an individual suing a team of lawyers :cirno_shrug:

@polarisfm @jang although a lot of the time with big tech they are not filing genuine DMCAs (those must contain "under penalty of perjury" IIRC) but basically using wink wink nudge agreements with the big tech company.
