LOL so i talked with them about this contract their shitty glitchy site COERCED me into, with THREE SERVERS, only one of which i wanted with NO CONTRACT and NONE OF WHICH I'VE EVEN INSTALLED AN OPERATING SYSTEM ON and their solution is to cancel two of the contracted servers and KEEP ME IN AN ILLEGAL CONTRACT THAT I DIDN'T SIGN UP FOR, CONFIRM, ANYTHING for the third one

@kaniini for summary:I visit the OVH site, attempt to purchase a dedicated server (with added setup fee, since I chose NOT to go for a contract to avoid the setup fee), their site errors like 5 times, redirecting me to paypal over and over again, I STUPIDLY run through paypal like 3 times before saying "fuck this", 2 weeks later i'm charged for 3 servers, I call technical support because billing isn't open, they tell me they can't cancel because i'm in a contract, i go "no, i'm not in a fucking contract, i didn't choose that option", they tell me I am, I attempt to call billing during the next week since they're only open 8am to 4pm EST on weekdays, before i even get to the robocaller that redirects me to billing or tech support I get 30 seconds of silence and a click and it hangs up, 3 times in a row.I send an email about the situation, cancel the recurring payments on paypal because I can't afford that, and just ignore it for a little because I'm a busy person who's busy with other shit. They never respond to the email, I call them back today, after seeing an email that says i owe them almost $200, they tell me that I can pay the debit i owe, they'll cancel two servers, and move the credit to the third, but i'll still be under a contract that I SPECIFICALLY DIDN'T SIGN UP FOR for the third server.

@pea @kaniini Tell them to to pound sand and give you back the money they already took from you, or they'll hear from your lawyer for 100x the amount?

@pea @kaniini If it's an illegal contract then you might have standing for fraud charges on OVH but aside from that you're likely fucked short of suing them.

@coldacid @kaniini i don't think the contract itself is problematic, just that I never signed it, or checked a checkbox saying i was even inclined to participate in it,

@pea @kaniini the text of the contract is immaterial. What's material is that they are trying to act as if you are under a contract that you didn't agree to in the first place.

@coldacid @kaniini and the problematic part is that i have no proof i didn't and they have incorrect proof that I did, most likelytheir site was spitting error page after error page and my assumption on the matter is that in some of its bullshit, it managed to convince itself, the backend server, whatever, that i had selected the contract option

@coldacid @kaniini @pea wait, do they have any US business presence?I'm not a lawyer, this is not legal advice, but...Because it was paid with PayPal, there's always flipping the script - instead of threatening to sue them, file a PayPal claim against them, and when they wave their contract in your face, tell them to fuck off. They can sue you, but...

@bhtooefr @pea @kaniini AFAIK OVH only has data centers in France and Canada. I could be totally wrong though, but they're primarily a French company.

@bhtooefr @coldacid @kaniini the problem with this lies in the "this is not legal advice" bit, considering that i doubt even the cost of buying out this entire contract would be less than talking to a lawyer, from my limited knowledge, but is still significant to me

@pea I wouldn’t worry about their lying bullshit claiming you’re under contract, just get PayPal and/or your bank to refund your money and find a better hosting company. This isn’t the first horror story I’ve heard about OVH. If they want to pursue the matter the burden of proof is on them that you intended to agree to a contract which they’ll never be able to do if their order site is that much of a piece of shit.

@pea @coldacid @kaniini check your jurisdiction's small claims limit, $3k is probably over it, making it *MORE* expensive for them

@foxwitch the concern is that i basically cannot take them to court if it comes down to that, I don't have the money to pay a lawyer

@pea why do you need a lawyer? Complain to PayPal and if PayPal won’t refund you file a chargeback with your bank. This is arguably fraud on OVH’s part and OVH would be stupid to try to sue you over it in US court.

@pea also if this is something that did have to go to court, the amount is low enough that you’d file in small claims court where you don’t need a lawyer to file
