Kinda feel like TFB sold out from the sounds of their own blog post because they didn't want to go to litigation. That means either they didn't have the money for litigation, or their case wasn't as solid as they thought it was. I'm actually leaning towards the latter given the weird concessions that were made, especially regarding the Star Control name.

@maiyannah Possibly also involving all the trademark trolling the other side were engaging in. The list does seem almost exactly what their original settlement proposal was back when they first made it but with a few extras that seem quite iffy.

@purplehippo It is, in short, not a settlement agreement their lawyer would have wanted them to accept if they had as strong a case as they presented their case as; so I can presume they either did not have the money to litigate (unlikely, a lot of fans put together a fund), or their position was much more tenuous, at least legally, than they put on. Immorality of Stardock's actions or how erratic and weird Wardell was acting unfortunately have little bearing on the legal facts of the case, unless they wanted to put forward a separate claim for damages incurred specifically as a result of Wardell's behaviour; which likely is a right they also surrendered in the settlement.

@maiyannah Seems that part of the agreement is the go "quiet" for some undisclosed amount of time to allow the other side to better promote their game and DLC. This I find fishy.

@purplehippo Any time someone says that there "wasn't winners or losers" in a settlement case, they were the one that lost out.
