       @jonny I sound like a broken record at this point, but whenever the legal status of LLM training data is brought up I can't help but think of Aaron Swartz and how he was treated like he did the heist of the decade for trying to release some academic papers to the public

       in a just world - if meta wins, all papers are open access, piracy is legal, and society dies. if elsevier wins, the fundamental conceit of the bet that all of capital is riding on is ruled illegal, the economy collapses, and society dies.in this world - they will settle, the information cartels will be allowed to steal all of human culture while it remains illegal for you or I to merely access it, the intellectual property holders still get to own our collective creative and intellectual energy, and society dies.

       everything you do is copyrighted by default. every user-generated content site needs to have a carefully crafted IP policy to force you to give that up as terms of using the site. that's not true of most text, though. the enforcement mechanism for copyright law is litigation, but usually that's more expensive than it's worth. but if everyone, everywhere has a guaranteed case against every AI company, then AI-as-LLMs becomes illegal.
