       Guys, we need to do law here. It appears the Supreme Court has just fucked up fair use and it is BAD. Hugely censorial to new works. Best outcome: a roadmap to argue around it in future cases.        Also, it appears that Alito has abandoned his own earlier copyright jurisprudence by signing onto the majority opinion.They've absolutely trashed Breyer dissents (and even the majority opinions in those cases), including one Alito had joined.

       @webmink I know this is obviously a climate change story, but it also seems to be a poor engineering (or supplying) story, because we should have the technology to build infrastructure that can work in wider temperature ranges. These are unpleasant but not absurdly unearthly. Trains should be able to work in hot climates too...

       I've always had mixed feelings about affirmative action: an awareness of why we need such programs tempered with concerns that it isn't a constructive way to address structural racism by making race matter. But I have zero faith in this Court to navigate these difficult issues.

In particular, I said of TOS: "There can be the lawyerly temptation to phrase them as broadly as possible to give you the most flexibility as you continue to develop your service.        @clay @riana @ncweaver It also isn't that straight forward. Will his comments violate the protective order, or the bail conditions? Because each one has different criteria for what is a violation, and different consequences. Also, I don't think either have jail as a consequence, at least not right away. He'd probably have his bail conditions adjusted, or the protective order adjusted, and maybe even more charges, but all that will happen before criminal contempt or revoked bail is on the table.

       @riana It's not just giving Trump extra chances, although the politics are such that it might be good to.But the legal mechanisms are different. I don't think either the discovery order or even the bail conditions make jail the immediate consequence of mouthing off. I think they'd have to go through an adjustment first before jail would be on the table as the next consequence.
