       Data retained by MS recall will absolutely be subpoenaed. It will also likely be discoverable by litigants. I might have to amend my usual warning to clients to not write anything they would not want to have to explain to a court to not doing anything on a computer they don't want to explain under oath.

       @geordie I can't remember what appliance it was but something broke a few years ago. The person I spoke to started rattling on about warranties, to which I mentioned the Competition and Consumer Act (without mentioning I am a lawyer. His response was to shout "don't threaten me."I still got the replacement though.
