I agree in a way. I think you should allow no fault, but a responding spouse can file for a fault cause, which are defined by law, and get damages. Alternatively, fault could be the initial filing. Because divorces are very messy regardless and fault petitions will themselves be strategically employed, fault causes have to be limited in kind and scope, and sanctions for frivolous litigation must be available. Possibly attorneys fees should be available to the winner as well.

The entire west coast of the US used to follow community tradition. The east coast followed the anglo separate property tradition. I'm "here" in California. And children being involved has no effect of spousal support. They are two separate issues / calculations. Even a mother who has primary custody can be forced to find work. In California work is not a factor in custody decisions. Now I'm not saying the system isn't otherwise fucked, as there are huge structural and substantive issues. Support for life isn't one of them.

We have community property here. That only really includes property / assessions that resulted from labor, so not inheritance or gifts from others, nor anything owned before marriage or after separation. To the extent that support is available, it's on the assumption that one spouse got to where he or she was based on community labor, but this is also why it's not forever. We recognize that the community did end and that any tail must end as well. Now separate property can be converted to community accidentally if comingled. You can also go either way by agreement (transmutation).

No one wins in family court, and the things ex-spouses do to each other is just gross. This is why I usually avoid family law matters. I do get dragged into it one every now and then if there's a narrow legal issue or it's a pre-existing client, though it's rare. And honestly my view in most of those matters is that everyone is an idiot. I only had one for a corporate client where the wife had become a hard-core drug addict where the client was normal. She died of liver failure before he paid all of the support.

I've never seen anything underhanded, but accidentally sure. It's very easy to do. You just have to put it in a community account. Because of this, I often prepare transmutation agreements making certain property separate property when drafting estate plans (I don't do a whole lot of family law work, but trust and estates is work-a-day) and particular where it's a late second marriage. My trusts also allow for account designations, e.g. separate property of spouse A, for this same reason, so they can put inheritance into an account titled in both spouses names as trustees without converting its separate nature.

Well this neglects the social responsibility of the community members - even blacks, the most technologically inert species knows that the group needs to act with prejudice towards something that threatens one of their group. A chimp without the troupe is very vulnerable and likely to die. A man should not be fighting on his own against women and the courts. Your tribe getting together to stone an unfaithful woman (thereby not forcing the man into the moral dilemma of protecting his family against his wife.
