       @mcc i mean, specifically, the government putting "the constitutional court can't overrule this law even if it is unconstitutional" into the text of a law.That seems like a really stupid legal loophole.

       @ratsnakegames Yeah, every non-chud canadian i know seems to hate it.As "Drew" already wrote, in practice it means "you can write legislation that violates the Charter, but you have to renew it every five years or it expires". That's… SOME protection. Not a very reassuring one.Also as I understand, using nonwithstanding used to be a remarkably rare event. In the last ten years (same time everything else happened) it's become kind of a matter of course it feels like.

       @shironeko @mcc the usual problem of "collective bargaining". If every teacher agrees to just ignore this order, then the state is in big trouble, but realistically at least some of them are not going to be willing to take the risk. And the more comply, the more vulnerable those that don't are

       @ratsnakegames @mcc yeah, the judges and police also need to grow a spine, but I guess the system selects for the spineless people that follows power instead of actually following the law.
