       In the category of Legal Silver Linings, today SCOTUS *once again* reversed the RWNJ-dominated Fifth Circuit (federal appeals court for TX/LA/MS). The case has to do with an advisory panel making recommendations to HHS about preventive health care. A unanimous, completely deranged 5th Cir panel held that the task force members had to be confirmed by the Senate (rather than appointed) because they exercise “unreviewable” authority.        As the SCOTUS majority finds in a “like, DUH” opinion, the HHS Secretary has plenary power both to overrule the task force’s recommendations and to remove any of its members.Two add’l points:1) Naturally, Justices Alito, Thomas & Gorsuch dissented because Reasons.2) The author of the deeply stupid 5th Cir opinion was Judge Don Willett. A great many people praise him because he’s evidently quite an affable guy. That may be true & would set him apart from Judge Ho, who relishes being a /2

       garbage human. (Judge Ho once wrote an opinion in which he intentionally and repeatedly misgendered a trans federal inmate.) Being better than an amoral trash fire is a pretty low bar tbqh & in any event Judge Willett’s opinions, as in this case, often trade in hackish result-oriented “logic,” so spare me the encomia about what a charming fellow this tool is. /fin
