@Nonilex Horse manure, Ms. Garnett. I don't imagine she would make the same argument were she arguing for govt funding of Islamic schools. The constitutional prohibition is to avoid favoring one religion over another, or all religious over the non-religious. Denying Catholic parochial schools govt funding would be discrimination, only if the state funded other religious schools, but not Catholic ones. It's constitutional to refuse to fund any of them, or to fund all of them.

@Nonilex I think Sotomayor has it right and Kagan has it wrong, or at any rate that Kagan's question about whether the school discriminates on the basis of religion misses the point. This isn't a Title VII discrimination case, it's an Establishment Clause case. The question is whether the government is establishing religion by giving money to religious institutions, and that has nothing to do with who's allowed to attend the institutions and who isn't. If a church posts "our services are open to everyone" out on their front sign, as many churches do, does that mean that it's ok for the local city government to give them the money to buy a new organ?

However, most states rely heavily on #private entities for their charter programs.

Burris said that Alaska, Virginia, Kansas & Maryland #CharterSchools are controlled by #SchoolDistricts, & in Massachusetts, the state considers the #school & the governing nonprofit that runs it to be govt entities.
She said other states have a mix of #public & #private actors, but in most states, charter schools are generally privately run.
