It bears repeating: EVEN IF there WERE a mountain of evidence tying #KilmarAbregoGarcia to MS13, he would STILL be entitled to #DueProcess, & the current #deportation would STILL be illegal. This is where #JDVance’s other argument comes into play.JD says KAG doesn’t deserve a “third deportation hearing,” meaning he already had due process while omitting that THE CURRENT DEPORTATION IS ILLEGAL. It is THIS FACT, that the US GOVT ACTED illegally, that reopens the need for due process.#law

@Nonilex California has a legal scheme called the STEP Act, which stands for "Street Terrorism Enforcement and Prevention." Without diving too deeply into the details, it dramatically increases the penalties for crimes that are committed "for the benefit of a criminal street gang." There are a lot of details about what "criminal street gang" and "benefit of" mean, and there's been a ton of case law on those points. A major component of any trial of pretty much any young or young-ish Black or Hispanic male defendant in California is devoted to litigating whether the STEP Act sentencing enhancements apply, which is to say to determining whether the defendant is a gang-banger. And it's always this stuff: oooh, he wore blue garments! (Yes; they're called blue jeans and lots of people wear them.) Oooh, he wore a San Jose Sharks hat. (Right, he's what's technically known as a "hockey fan.") The principal point is that we argue about this stuff in court; we don't just let the cops decide.

Of course, the citizens of El Salvador aren’t privy to the secret negotiations Bukele made with MS-13 – details that were going to be made public when the U.S. government’s case against the MS-13 defendants went to trial. Which may explain why the Trump administration quietly dropped these charges last week and put the charged MS-13 members on the third plane bound for El Slavador (and which included Abrego Garcia). -1

@Nonilex um...it's also not acceptable to deport people to random countries they're not actually from. That's not a compromise anyone should call for. If he wants to apply for asylum in a different country, that's his choice, but he can do that once he's free and back in the US. Also, note that people who are being returned to their home countries to answer for crimes they're accused of committing THERE get extradited, not deported.
