@Nonilex But it wouldn't be smuggling if the U.S. welcomed the guy. It's like, when I return from a trip to Europe with a suitcase full of dirty laundry, I'm not smuggling the laundry because the U.S. has no laws against importing dirty laundry. When he says "I can't smuggle him into the country," that clearly implies that the country wants him out, so therefore bringing him in would be smuggling. If the government were to say "he's welcome to be here, we're fine with that," that would facilitate/effectuate/whatever his return. That's exactly what the courts are ordering the government to do, and what the government is in utterly crystal-clear unambiguous contempt of court for not doing.My crystal ball says that Xinis isn't going to actually issue a contempt order. If she intended to, she would have already. Besides, if she did, the Roberts court would just come up with a way to vacate it. They've made their position extremely clear. I hope I'm wrong.

Who, exactly, gets to decide what information the government can share?) @Nonilex Well, the question of what, exactly, it would take to get Judge Xinis to utter the C word remains unanswered. The judge I worked for all last year was the nicest and mildest-mannered guy I've ever met, and he would have had someone escorted out of the courtroom in handcuffs about two jerk-arounds back if this had been before him.
