what agencies outside the executive branch of the Federal government are able to enforce Federal law?suppose the courts, even the current Supreme Court, were to agree unilateral dismantling of an agency and unlawful access to classified documents are Federal crimes, if Trump doesn’t enforce the law can no one?

@interfluidity (I'm not a lawyer, of course.) I think it depends on what you mean by "enforce the law." If you mean, "bring prosecutions for violations", that's strictly the executive. But courts can issue injunctions that require certain behavior or risk contempt of court.But maybe you meant "as a practical matter, how can courts compel the executive to do what they say", and I guess that's really a political question. Given OMB's withdrawal of their memo, it seems to me that Trump still intends to obey the courts (more or less). Obviously nuts that we're having such a discussion.

@interfluidity The answer is none.What it comes down to , is a simple question, is all executive power vested in the president and subject to the will of the people who elect him, or not?If not, it's a huge problem. Constitutionally it is completely vested in the president and Trump is proceding accordingly. What would stop him from granting the necessary clearance to anybody he wanted?

@Phil no, it is not. we don’t elect a dictator. we elect a person whose duty is to “take Care that the Laws be faithfully executed”. USAID is constructed by Congress, by law. Classification rules are the law, and the President has not declassified the documents people with no clearance have now accessed.

@_dm what’s happening at Treasury and USAID, the recission of the OMB memo but cagey language about what the EOs might still freeze, suggests to me an extraordinary degree of willingness to test the enforceability of the law.

@interfluidity Yes, absolutely. But I think they have a desire to avoid outright violating a judge's direct order.How strong a desire is anyone's guess.

@interfluidity Who said that Trump didn't grant them clearance?And if All executive power is not vested in the president, than voting is utterly meaningless and the people can not effect any change as most of the power is not accountable to anybody.Power that is invested in people that are insulated, will always lead to corruption.It is becoming clearer all the time that USAID was corrupt.Since it's a development agency, why classificaiton at all?its very fishy.1/2

@Phil bureaucracy is the form of institution by which nearly all human action is coordinated at scale. every military is a bureaucracy. does that upset you?article 1 of the Constitution creates Congress, before the executive, whose role is to put into practice the laws that Congress creates. the people exercise their authority by electing a legislature, not by electing a king.your glory will become mass atrocity quite soon, if it is not nipped in the bud.

@interfluidity The foriegn assistance act was passed by congress, so it is the presidents responsiblity to carry that out. How it is done is mostly up to him.USAID was created to do this by JFK thru an Executive order. If created by one president it can be uncreated by another.The key word was not bereaucracy but CORRUPT. and it has become so and it's very evident.And the presidents job is to make sure the laws are "Faithfully" executed.This is exactly what he's doing.
