The normal and plain reading of Article II section 2 clause 1 of the US constitution grants the president the power to grant repreives (reduction or elimination of punishment) or Pardons for offenses against the United States. Nowhere is it stated or implied that these can be preemptive. In fact when taken with the principle of innocent until proven guilty, there is no offense to be pardoned until AFTER a conviction. I dont believe it was intended to be preemptive and see no grant of such power.

@Phil Reduced to the equivalent of a "Get Out of Jail Free" card at this point.However, I do like the theory that they are now in a position where they wouldn't be able to plead the 5th amendment.Put them under oath and hammer them with questions.

@aquanaut642 I'm not sure about the 5th ammendment thing. There is an old ruling that the effects of a pardon cannot be offensive to the constitution and I can see somebody making the argument, based on that, the his 5th ammendment rights remain intact. not a good argument but bad ones prevail all the time.

@Phil I don't listen to what dems say. Congress and bankers will be punished for all their crimes. I want to see their money confiscated, including all the crypto they bought and stole. Warren is quiet most of the time, but she helped banks steal and money laundered nearly a billion dollars. Someone posted that about her a couple weeks ago.

@realcaseyrollins Many years ago, SCOTUS found that the presidential pardon power can be preemptive. I don't know what they based this on, since the text doesn't support it, and I think they got it wrong, but I am skeptical that they will reverse that decision.

@Lori @Phil Saw some interesting discussion that calls into question the legality of a pardon for undiscovered/charged crimes. Seems this flies in the face of the whole "Innocent until proven Guilty" concept.In the big scheme of things, Hunter is a small fish, the bagman at best. At the end of the day it just politicians doing politician things, an was too stupid to avoid getting caught.The real crime will be pardons for the big "Get Trump" gang. Congress, FBI, intelligence, CDC, etc...

@Phil You are absolutely correct. As Hamilton explained the powers werej just like the Englinsh Monarch held.These pardons are not explicitly for Hunter but to cover the far-reaching corruption and crimes for which the Biden Crime Family and many in congress are guilty of.Even following the Constitution, the idea was to pardon a specific cse, not a blanket protection extending beyond the Statue of Limitations.

There's no doubt that it wasn't intended to be used by a president to provide blanket protection (and in effect license) for crimes of their families. That doesn't make it suprising as Biden has never had any honor.It's true that HB doesn't matter much. The most important thing is that everything is completely exposed so that their deluded voters can no deny it no more. They won't be able to show their faces in public.
