I don't know where Congress claims to have gotten the power to dictate state voter registration procedures, but apart from that, this shows how proof-of-citizenship requirements can disenfranchise more legitimate voters than they prevent improper registrations.https://www.newsweek.com/virginia-illegally-removing-voters-before-election-doj-1968004#NewHampshire #Virginia

@gmcgath The alternative is running the risk of allowing illegal immigrants to vote. Sure, I'd wage most ppl fleaing Latin America would vote Republican rather then Democrat, as they've experienced the horrors of communism first-hand, but still they're not supposed to vote.

@gmcgath Have you ever read Article I, Section 4, Clause 1 of the U.S. Constitution?

@mls14 You're referring to the TPM of electing senators and representatives. Does that extend to the criteria for voter qualifications? I don't think so. It required a Constitutional Amendment to abolish racial qualifications for voting and another to let women vote. If Congress could have done it by passing a law, that wouldn't have been necessary.1/2

@mls14 The provision is specific to electing the House and Senate, which casts further doubt on the idea that it can be elected to registration. It would potentially create a two-tier system in which the states decide how voters for state offices can register, and the federal govt decides how voters for federal offices (not including the presidential election!) can register. It's not a tenable interpretation.

@gmcgath Case law regarding this is clear and has been in force for 3 centuries. Congress can, and often has, regulated how states may carry out voter registration. The only part of the process they can’t override states on is the “Places of chusing Senators”.

@mls14 That was a side observation anyway, and I don't feel like following it too far right now. The main point of my post was that requiring proof of citizenship for voter registration creates more problems than it fixes.

@gmcgath I agree, and Congress should pass laws preventing such abuses of voter registration rules by the states.

@mls14 In this case there already is such a law, or at least so the DoJ argues.
