"ConclusionThe dramatic reversal of past EPA policy by the Obama administration has been met with mixedreviews.Environmental groups in most instances have lauded the EPA’s decisions to revisit the Bushadministration’s interpretations of environmental statutes and regulations, and praised what theyhave called a return to science-based policy at the agency.Others, particularly some in the business community, have questioned the wisdom of suchdramatic changes in EPA practice.These interested parties have argued that such remarkable changes in the agency’sinterpretation of the environmental statutes it enforces both upset settled expectations andundermine the credibility of the agency and the processes it employs to develop thoseinterpretations.Whatever the merits of these respective positions, the EPA’s actions under the Obamaadministration serve as a stark reminder of both the breadth of the EPA’s discretion and theneed for interested parties to look for and recognize the many opportunities and pitfalls thatsuch vigorous agency activity presents.
