Via A Weissmann:Primer on what Trump's arguing to get out of DC trial:1 He's immune from crim suit based on actions w/in "outer perimeter" of Pres's functions (the std Court has applied to civil suits agnst a former POTUS)2 Actions alleged in indictmt were just speech w/in outer perimeter3 He can't be crim chgd unless 1st impeached, convicted by Cong4 Bc acquitted by Sen, he can't be chgd.Trump may prevail on #1 ( I don't think he shd), but I think no way he'll win on 2-4 so will ult lose

2/ Weissmann, cont'd.To be clear even if Trump prevails on the law on #1, he has to win on #2. Ie the facts alleged have to be within the president’s job functions. Only then could those actions be immune from prosecution. Smith argues they are not, and gives examples of why not.

@GottaLaff I just keep coming back to the J6 Committee testimony from Barr, Herschmann, Krebs, et. al, that Trump was notified that there was 'no outcome-determinative fraud' discovered. Unless he wants to go with an insanity plea - and he won't - he's toast.

@TomShafShafer He SHOULD be toast. We thought he was toast in 2016. We now have a bunch of Trump courts. So... I'm not confident until I see him convicted and overruled.
