It appears that the U.S. Constitution that everyone swears an oath to protect and defend, waves around like a symbol of all that’s holy, and totes around next to their heart in their pocket only stands for something if it lines up with what you want it to mean.        @WarnerCrocker you might be misunderstanding me. I wasn't clear. I don't think he should be kept off the ballot. he should have at least been charged with insurrection before the 14A can be said to apply imo. we're getting into dangerous territory when there's federal law you can be convicted of, that's referenced by another law, and  judges and other state officials can decide that first part just isn't necessary. imagine it was "no murderer can be elected etc". could OJ be barred?

       @wjmaggos I think I got you. I think we disagree.. I’m in the camp that a conviction isn’t necessary. Not required by the Constituion as far as I can read, especially since he’s owned up to his role. I think that comports with existing law. I’m not a lawyer. This is my opinion. I’m as guilty of holding one as is everyone else. The bottom line is we have laws that are poorly written and require interpretation and courts and legislatures that are either apparently afaid to act, or act willynilly.

       @threalist @WarnerCrocker true but Democrats see Trump's (backed up by his supporters) continual claim that he won in 2020 and J6 despite losing in the courts as disregarding the system. they see the refusal to have hearings and votes on Garland for SCOTUS when they then rushed through Barrett in a similar situation as Republicans disregarding the system.

       Things were better for us when super majorities were required to approve appointments. Now that bare majorities can decide, offices like Justice of the Supreme Court and executive branch directorships are becoming polarized, when they shouldn't be. Those Senate rule changes about appointments were terrible.

       @caekislove @wjmaggos @WarnerCrocker i ran into similar issues discussing the first impeachment also...they all pretty much acknowledged to me that Biden comitted some sort of activity worth investigating but insisted that trump couldn't legally do anything that would have increased his own chance of being reelected...they would go silent when i asked what else a president couldnt do if it might get him reelected...then i became a nazi...

       @wjmaggos @WarnerCrocker That is not correct. Trump was charged with insurrection in his second impeachment. That is when he could have first been convicted, but the Senate voted to acquit. Arguably, that means Trump can never be tried for that insurrection attempt again, or at least that’s the argument his lawyers have been making.
