I had the opportunity to speak to a retired MD state attorney (prosecutor) a few days ago.I asked him a question about consent of the governed and he told me to email him my questions instead.Well I did, and unsurprisingly I haven't heard back. And yeah, he's not going to answer my questions because to do so honestly would likely shatter his entire world view. The questions included in the thread below.

       1) Government derives authority from the consent of the governed. Do you believe that a Union (of States) can be held together involuntarily? If states express explicit non-consent, a desire to secede, and are subsequently met with violence (1861), does that government have authority by the consent of the governed? If so, by what measure is that consent determined?1.1) What recourse do the people have to express non-consent?

       2) Do you believe that Marbury v Madison (1803) was correctly and legitimately decided? Do you believe an unelected oligopoly (the Supreme Court) has the bona fide Constitutional authority to legislate from the bench and impose their will over the entirety of the nation, beyond the parties named and present before the court?2.1) Is there anything that prevents Congress from reducing the number of Supreme Court justices to a single appointee?

       3) Congress passed the 18th amendment to prohibit manufacture, sale, and transportation of liquor, then repealed it with the 21st amendment. Today, the Federal government prohibits the manufacture, sale, and transportation of much more than just liquor (via Executive agency). Why didn't the Federal government establish Executive agencies to regulate arbitrary goods in 1919 like they do today?

       4) Do you believe that Maryland juries should be (permitted to be) explicitly instructed about Jury nullification, as Article 23 of the Maryland Constitution would suggest?(emphasis below is mine)> Art. 23. In the trial of all criminal cases, __the Jury shall be the Judges of Law__, as well as of fact, except that the Court may pass upon the sufficiency of the evidence to sustain a conviction.

       5) Other than double jeopardy, the state risks nothing when charging someone and bringing a case. This enables vexatious prosecution for which the defendant has no recourse. A potential solution to this problem is to require the government to ante and risk something when bringing charges (for example, pay the legal fees of the defendant's private legal representation). What are your thoughts on this, and can you think of other/better solutions to this problem?

@eriner this is a good point, "permanent union" and "consent of the governed" are seemingly not compatible.

       7) Do you think that the government (Federal and State) valuing your time at $0/hr for the purposes of income tax is legitimate? The current definition of income tax, a tax on gains above and beyond what you previously, only makes logical sense in the current implementation if the government values your time and labor is valued at $0, thus allowing governments to impose a tax on the entirety of pay received as a trade for labor. Is "income" defined statutorily differently than I've described?

@jeremiah @eriner I think it means wages aren't/shouldn't be considered income because you trade it for your time/labor rather than it being an investment increase?

@jeremiah I have a limited resource; time. I trade that time to others for value ("money"). The government imposes a tax on the entirety of the receiving end of the trade saying it is "income". Income, to my knowledge, isn't statutorily defined. But it means gains above and beyond your basis. A *trade* of my time for value isn't a gain; I've lost time. The value of basis remains the same on both sides of the transaction because I've voluntarily traded one for the other."Taxation" is theft.

@eriner i agree with the state pays - upon loss. No need for lawyer fee suits/countersuits - just automatic if the state loses. Opens up a whole new incentive for public defenders if they can set their fees for victory while they accept base pay for losses.

@eriner Half joking blackpilled answer.Slaves cannot consent.Nearly all Americans are Slaves to the state, given slave security numbers at birth.Your time is the states, therefore all income you are allowed to keep is at the behest of the government.

@eriner Hell, if I didn't vote for someone, I don't consent to be governed by them. I'm just compelled by force. It always comes back to force.

@Viking @eriner @jeremiah "Sokath, his eyes opened". There is no statute defining income. That's why they call it voluntary because you're supposed to volunteer the information cuz only you know how much profit you have made above trading your skills, goods, and time. The scam was having businesses report wages paid to you AS INCOME & Withholding (a tax estimate prepay) as bait so you accept this as a legal truth by trying to get a refund back.

@Viking @eriner @jeremiah Originally the federal income tax was defined as a tax on OFFSHORE income (foreign PROFITS in your name, converted to dollars & imported into the economy). The scam here was to fake jurisdiction over all by basing the IRS in Puerto Rico, hence offshore, and creating a legal strawman account there in your name in all capitals (to avoid forgery on their part) . By accepting it as yours, you now have offshore income that they can tax. No laws, corp regs detail how much

@eriner The crisis of Marbury v Madison was that it allowed line-item veto of the ingredients in a bill. The founders probably intended for the court to be able to veto bills entirely, which would send them back for editing.

@eriner This one has bugged me for years. They have no incentive to make the tax return process seamless because they pay nothing for it.We should be able to deduct our salaried rate for the time it takes to do the return.
