Good morning everyone. Some time ago I said that the left needs to stop idolizing the GDPR.I decided to elaborate on that and explain how and where the political economy of neoliberalism is alive and kicking in the GDPR, how alternatives would look like and how we (don't) get there ๐Ÿ‘‡https://www.malteengeler.de/2023/09/14/the-left-needs-to-stop-idolizing-the-gdpr/

The blog post is primarily meant to inform left tech circles where the lack of tangible progress has given GDPR the role of the second best thing. I don't mean to just talk it down though. GDPR has its positive aspects. But we have to avoid having ourself lulled by its existence.

The blog post also is a write-up of my (German) talk at this years @republica. So in case you understand German and prefer a audio-version of the written article this is pretty much it:https://www.youtube.com/watch?v=xwze7G0rn6M

@malteengeler the problem is that #GDPR allows #paywalling of #privacy as a "premium feature"...Also it does nothing about shit like #CloudAct because it's not being enforced at all...

@malteengeler For me, the most important sentence of your essay: "A truly post-capitalistic data protection regulation would have to be embedded in economic environment where digital infrastructure, social media and services are not privately owned, but under local, decentral, or collective governance exclusively devoted to the interest of the public and the local communities."

@malteengelerWould your critique be different in any way if the GDPR were actually enforced fully (e.g. by disallowing consent to hundreds of trackers since that can't be free, informed and meaningful consent) and thus making surveillance based advertisment a near impossible business model?

@malteengeler @anneroth yeh, but no. #gdpr gives citizens rights. In a #capitalistic world sure. These are Still human rights in a digital word.

@malteengeler Thank you ๐Ÿ˜In the libertarian socialist tradition, there is a belief that: without freedom, there can be no equality; and without equality, there can be no freedom.I think I've seen different variations of this. For GDPR, I don't think that we need to be so afraid of embracing the individual's digital rights, but to find its counterpart in a similar saying:"without [x], there can be no individual digital rights; and without individual digital rights, there can be no [x]"

@malteengeler a bit too much ideology and bipartisanship, but this part I agree with 100%!โ€œOnce data became an economic category, individual consent stopped being an act of individual self-determination and became an act of economic necessity. [โ€ฆ] individual privacy is reduced to a question of economic capacity. [โ€ฆ] In a world where digital services have become essential for everyday existence, most people have little actual choice but to consent to their data being processed for profit.โ€œ ๐Ÿ‘Œ๐Ÿป

@malteengeler we all need to write and think more about what a left tech means. Being the number 1 person guilty of this, I don't think we have developed the right narrative to reach politician and parties outside of our own bubbles.

@malteengeler Thanks for the interesting text which I ended up reading twice today. I tend to agree with most of your arguments, but don't really see the "idolization" mentioned in the title or "celebration" mentioned in the text. Are there any specific instances of left parties or organizations you have in mind? At least here in Austria, I can't think of the SPร– or KPร– making broad statements to that effect. (That also supports your opening argument of the left's lack of strategy for digital.)

@malteengeler Nice, I've been hoping for this perspective in writing for years, thank you! One takeaway would also be that, focussing on personal data, we have been looking in the entirely wrong direction. What should be at the heart of a leftist theoretical framework regarding data protection, is not the mere fact of personal data being processed, but the exploitative relationship between controller and subjects. The concept of personal data seems to me merely as a liberal smokescreen - we should do away with it.Now what I was missing in the text though: what does a post-capitalistic data protection regulation look like?

@malteengeler Sorry, I was very unspecific. I was wondering whether a data protection regulation (or equivalent) will still need to be in place after the transformation, and if yes, how would that look like. It is probably a much larger question regarding the future of subjective rights, though.

@yassin There would be so much to talk about there, yes. But it so much depends on the specifics of the economic alternative humanity and it's many communities develope to just say "the GDPR must look like this". The law will always just follow the social and economic order of its time. I could come up with broader outlines though, but that was beyond the scope of the article.
