Saw a fun question on Reddit, which might be fun for all my @edutooters out there, especially in #law #criminology and #sociology Could a vampire policeman enter my house if they had a validly executed warrant? This raises interesting questions about how and why law applies to citizens, for example. Thoughts? Considering using this as an icebreaker when term starts...#LawFedi

@RuthFlaherty@techhub.social @edutooters@a.gup.pe I say no -- a vampire's inability to enter a house unless invited is a supernatural restriction, backed up by a power greater than mere violence.

@whalecoiner @RuthFlaherty @edutooters Who gives permission? The owner, the primary occupier (eg a rental tenant), a non-paying occupier, a child, etc? If the owner, what if the owner is a company? A shell company owned by an offshore trust? Is it the trustees or the beneficiary of the trust? Also, what are the implications of leasehold v. freehold ownership? And under what circumstances does a court order override property rights in respect of vampirism and permission to enter?Billable hours!

@cstross @whalecoiner @RuthFlaherty @edutooters The “threshold” rule obviously has to do with whether it’s “your home”. That is, it’s not some piece of paper that humans agree means you can take it away from someone. It’s a moral question about one’s home, not an ethical question about resource control.

@JoshuaACNewman @whalecoiner @cstross @RuthFlaherty that's where I stand, vampires and metaphysics are beholden to human law.Vampires can't enter a place where people live without an invite from the people who live there. I don't think it relates at all to ownership or law in that respect.But... fun thing to consider is can vampires entire an office space of a programming company in crunch time without an invite from a programmer?

@whalecoiner @shiri @cstross @RuthFlaherty All are yes, except for your friend's house, which you just defined as their home and not yours. But, yeah, a cardboard box is definitely someone's home, as is a yurt, an igloo, and a giant shoe filled with children.

@JoshuaACNewman @whalecoiner @shiri @RuthFlaherty What about Baba Yaga's hut, which is arguably alive in its own right? (It walks around, it eats things …)

@whalecoiner I believe the typical terms are any place you live in, so hotels/airbnb typically won't count because they're just places you're visiting. The office building mention was because during crunch time programmers often end up practically living at the office for weeks. It basically raises the question of what qualifies as someone "living there" for the terms.@cstross fantastic question? Does it differ if you're home is a living entity itself? I think it may count because this kind of myth typically derives off of the "You have to invite the devil in" Christian logic that is typically applied to possessions as well... and technically entering Baba Yaga's hut would count as a possession I think?@RuthFlaherty And there's the question of what qualifies as life for the vampire curse? And then, what are the boundaries? It might mean the vampire just can't enter the server room?@JoshuaACNewman

@shiri @whalecoiner @cstross @RuthFlahertyHm: a twist:What makes a home is the hearth, right? If you've never cooked for the people who live there, it's not a home. If you eat out all the time, you're more vulnerable to vampires!

@RuthFlaherty @edutooters @cstross I checked the 1979 Advanced DnD Monster Manual and the 1993 Monsterous Manual. Sadly, neither mentioned warrants. The Monsterous Manual says vampires will use their charm ability to get permission to enter residences. 🧛‍♂️🚔

@JoshuaACNewman @shiri @whalecoiner @cstross @RuthFlaherty What if you eat in, but it's always delivered or is takeouts, so no food is ever prepared there

@bellinghman @shiri @whalecoiner @cstross @RuthFlahertyDefinitely not. You didn't cook for family and guests. Cooking is holy (see: ropes of garlic).

@bellinghman @shiri @whalecoiner @cstross @RuthFlahertyNot just being on a diet. It's whether you're feeding your family and visitors. That's what makes it your home.If you're not feeding your family and visitors what sustains them, it makes you vulnerable to vampires!

@JoshuaACNewman @shiri @whalecoiner @cstross @RuthFlaherty As someone who has lived in his own, I'd differ. Feeding yourself is my minimum. Ok, I had cats that I also fed, but though I reckoned it was their home too, they didn't necessarily agree

@roboneko They perceive the state as either the Divine or as the devil depending on its political disposition. If it's left wing, it's divine, and if it's right wing, it's the Devil. Notice how ACAB fascism under Trump became Our Democracy under Biden@lispi314

Well, what I meant is, they absolutely do ascribe metaphysical properties to the State, it’s just that whether it’s perceived as angelic or demonic is a binary choice between sufficiently obeisant to their outlook and insufficiently obeisant to their outlook.

@cstross @whalecoiner @RuthFlaherty @edutooters if it's a physical repelling of the vampire, that is, if the vampire cannot enter a place it does not FEEL welcome, then ownership of the domain boils down to the mental state of the occupants. Even if they are not at home, a vampire will feel too much unease to violate their residence without a feeling they have been welcomed in.How much a warrant can assure the vampire that yes, they are allowed, depends on the vampire, really.

@fnordius @whalecoiner @cstross @RuthFlaherty ah, a favorite of mine, the affably evil vampire who is a complete stickler to intense rules of hospitality.
