@not2b ZoL has diverged quite significantly from upstream, and Oracle don't own it. But almost all of it is licensed in such a way that newer versions of CDDL would automatically apply to it.

@mjg59 in theory that would just mean rebasing from MPL 1 to MPL 2, but I’m sure you know the obstacles in practice have nothing to do with that.

Oracle really doesn't care about free and open-source software. They coast on the success and innovations of the community and keep a Linux distribution available for those that may prefer that over the UNIX operating system that they still offer.

@mjg59 CDDL is the superior license here. Without CDDL ZFS is a patent land mine.The problem was never CDDL. It was always with the linux community and NIH syndrome of that community.

@mjg59 Why would you expect a corporation that spent a decade fighting against fair use of the Java API to do anything like this? As a corporation Oracle has never supported anything that didn't benefit them. This is a marketing stunt that they are using to leverage their position in the corporate Linux space against their largest competitor.

@mjg59 license grants which don't follow along with a license can also be changed or revoked so any GPL based Solaris based on ZFS and dtrace or ... patents is under constant threat of Oracle exploiting dependence on it's product for a quarterly numbers boost.Not even core patents of ZFS have expired let alone the ZFS relevant patterns cited by such core patents. @dexter ISC is a very different license than the current CDDL (which was based on version 1 of the MPL). If Oracle was to choose a permissive license, the lawyers would want the UPL they created and got OSI to approve instead of someone else’s version.
