I am once again encouraging people to reject the idea that terms of service should have any legal significance whatsoever

How the fuck do you apply terms of service to a service that allows people on other servers to read the data without agreeing to the ToS

Using the tools of the oppressor against them is a perfectly legitimate short term strategy but could people please think about what the ideal future looks like before arguing for increased legal control of services

@mjg59 People also need to get used to saying "I don't care if it goes against your corporate policy: it's the law."

@mjg59 we don't even need increased legal controls. we already have the legal controls, they just need to be applied

@mjg59 that is a clever take on the "oh no, big tech joins our safespace".

@brot There's a whole bunch of things that can be done here and "Let's use terms of service" is not one of them

@mjg59 All big tech wants is write terms of service, eat hot chip and lie.

@mjg59 I first started to question the GPL when the FSF was so happy that the DMCA gave it more teeth. It had become part of the problem.

@mjg59 TOS forms the agreement to be duly authorised to access the system. The law does not care about API, protocol, or implementation.“The law is not colour blind.” - mskala / “What Colour are your bits?” 2004https://ansuz.sooke.bc.ca/entry/23

@mjg59 Kinda reminds me of the BitKeeper controversy, when its author accused the guy who reverse engineered it of violating its terms of service, but that guy pointed out that since he never installed BitKeeper, he never agreed to any terms…

@mjg59 Terms of service and other licenses and privacy policies are there solely to protect the service provider. They're painful to read if all you're looking for is how they restrain themselves from gorging on your data.

@mjg59 depends where you live in the US. This issue is going through the courts in different circuits currently. Some places there are stipulations if it is valid. Some places they are not. Some they absolutely are. This was from the 9th CCoA:https://www.govinfo.gov/content/pkg/USCOURTS-ca9-20-16900/pdf/USCOURTS-ca9-20-16900-0.pdfThere is another big one from DC Circuit that went a different way too.

@mjg59 The Chief Justice of SCOTUS admits he doesn't read the ToS. If the "supposedly" most brilliant mind in the nation cannot be bothered because ToS are indecipherable, legalese gobbledygook, then what chance does the ordinary citizen have?(Or, maybe the truth is simply that Roberts is a partisan hack upholding a corrupt system?)https://www.abajournal.com/news/article/chief_justice_roberts_admits_he_doesnt_read_the_computer_fine_print
