I stopped following what Creative Commons the organization is doing these days, and only now found out they're supporting the argument that AI companies scraping random materials from the internet and then selling access to generated knockoffs, should be considered fair use. https://creativecommons.org/2023/02/17/fair-use-training-generative-ai/

@LeslieBurns I disagree with that characterization. Question is which artists — all creative work is derivative. And current copyright regime is simply insane as far as locking culture in corporate vaults is concerned.I guess they are trying to navigate a situation where for years they claimed that sampling of short clips and using them in a new song in a different context should be considered fair use (I happen agree with that).I do agree they navigate it extremely poorly here!@despens

@rysiek @despens oh, no… I completely disagree with you. Copyright is the only reason artists can make money. Sure, corporations take advantage of that, but no more so than they take advantage of EVERY law they can. CC was never needed (in the USA).

@LeslieBurns @despens I did not say copyright should be abolished. I do believe copyright needs to be dramatically reformed.CC is not *the* solution, but CC licenses *do* allow me to take some of that power back, for example by insisting my piece gets published under CC By-SA, even if I transfer the rights to the publisher.Which allows me to use my own work later. Which I in fact do.And I appreciate them for that.

@LeslieBurns @despens I think they focused here way too much on technicalities ("take a piece of work and put it in a different context"), and ignore the bigger picture (power dynamics of corporations being able to — poorly — "replace"/simulate artists).It *would* make sense for #CreativeCommons to instead say: this is not sampling, because the point of this is to take the artist out of the loop, the technology gives the powerful even more power, and strips artists of that power.
