If a #standard gains the force of law in Europe, it is not entitled to copyright protection and must be freely available. Massive.https://curia.europa.eu/jcms/upload/docs/application/pdf/2023-06/cp230110en.pdfWell done @carlmalamud - again.

Now we need to make sure you don't have to pay royalties to implement standards that gain the force of law either - how about it, @carlmalamud ?

@webmink let’s win the first point first. It ain’t over until it’s over. Still need the judgment from the court.

@webmink @carlmalamud Could you explain this to an ignorant person, please? What is a standard?

@webmink @carlmalamud What does this mean for patents? If a patented thing is made into a standard (USB-C for phone chargers) then does it change anything with regard to the royalty payments?

@webmink @carlmalamud I always thought it crazy that you have to comply with a law but have to pay to get the details. So I agree with this.Even those stupid no smoking sign laws (the signs were stupid, not the stopping smoking aspect) referenced A5 as defined by a British Standard (which therefore defined tolerances etc) which you have to pay to get.

@webmink @carlmalamud The implications of this are huge.Could this mean the standards organizations will need to have a different business model? Most likely so.Will they change to something like #W3C or like #IETF?#ISO #IEEE #ECMA #ETSI

@webmink @carlmalamud This is just the AG opinion so far, not an actual court decision. The judges may still decide in a different way.

@blue_led Aware, and @carlmalamud is of course cautious. But no matter what happens the ESOs are now on notice.

@webmink @carlmalamud ATM its is "just" advice to the court. We will have to wait for the decision.

@webmink @carlmalamud for the ignorant, what are the implications of this? What are some examples of standards that are currently not freely available?

@carlmalamudYeah, I'm following and have pretty much since you started. I am loosening the mortar in a different place (the impact of intentionally-placed SEPs) but appreciate your work.
