And here is the indictment:https://www.justice.gov/d9/2023-05/santos.indictment.pdfWe already read the punch lines. Now it's time for #FunReadingLegalDocuments The indictment introduces him as "George Anthony Devolder Santos" then refers to him as "Devolder Santos."It also explains the name of Devolder LLC formed May 11, 2021 in Florida. Devolder Santos was the sole owner. There is also Company #1, the identity of which is known to the GJ. 1/

Oooh the plot thicken and I'm only on page #2. Company #1 had two managers one of which was Santos. (I'll call him Santos.Person #1 is a political consultant operating in Queens County, who acted at Santos's direction and on behalf of Company #1.(Is Person #1 is saying Uh Oh? Or did Person #1 testify?)Through this all, Santos was employed at an Investment Firm and drew an annual salary of $120,000.I assume we're getting this detail because of the benefits fraud.2/

Santos told supports to contribute funds to Company #1 on the false pretense that the money would support his candidacy but he used the money for luxury designer clothing and to pay off his credit card bill.He told Person #1 to lie about the nature of Company 1 and what the money would be used for.Next comes an explanation of the Federal Election Campaign Act of 1971 and that Santos knew he was lying when he told supporters that Company #1 was registered with the FEC as a Super Pac.3/

Santos keep having Person #1 do his dirty work: feeding Person #1 lies, knowing that Person #1 would pass that information to prospective contributors. So Person #1 is a dupe. The indictment refers to emails and text messages, so they had a cooperator or they executed search warrants. Lots of lies are documented in these emails and messages. There is something so stupid about criming via text messages and email. (Even Trump, for example, knows better than that.)4/

Now we get to a description of how Santos lied about being unemployed when he was employed (all those docs can be easily obtained by the DOJ) and how he received regular deposits into his personal bank account from the US Department of the Treasury. Those records could obviously be easily obtained by the government. And under the Ethics in Government Act of 1978, as a candidate he was required to file House Disclosure Statements at designated intervals. Aaaand he lied on those.5/

The first 5 counts are Wire Fraud. (The statute that gives the feds jurisdiction over what would normally be state crimes.)Use email and texts and (1) it's easier to prosecute you because there's documentary evidence AND (2) the feds can get you.Pro tip: Just don't commit fraud. From Jamie Dupree: The week that Santos is indicted for the House is slated to vote this week on a bill to help states recover fraudulent COVID unemployment payments.Oh, dear. Will they be embarrassed?6/

I didn't follow the House debates on that, but goodness I wonder if Santos supported that bill.Santos: "Get those cheaters! Don't let them get away with it."Counts 6 - 8, unlawful money transfers.Count 9: Theft of public money Counts 10 & 11: Fraudulent application for unemployment benefits.Count 12 & 13: Lying in House Disclosure StatementsNext the feds make clear they want the money back under forfeiture laws.well, there you go.7/

@Teri_Kanefield If ultimately convicted, and perhaps serving time w/o resigning from seat in the House, is there anything preventing him from also being nominated & confirmed to the Supreme Court?

@Eejittery @Teri_Kanefield I’m going to go out on a limb and say that surely, SURELY the House would expel him if he’s convicted. As I type that, I realize the odds are probably 50-50 at best.

How soon will Santos' trial start, and what's the earliest date on which he could be convicted? Pretty close to the 2024 election, I'd think.I don't think McCarthy would even allow a vote on whether to expel Santos. But if he did, I don't think a 2/3 majority would vote to expel him.@MarkAB @Eejittery @Teri_Kanefield

@barney @MarkAB @Eejittery @Teri_Kanefield There's a TX Republican gadfly who is about to test this hypothesis. McCarthy is probably sweating buckets as we speak.
