If Ed Sheeran looses this case we are all fucked. This chord sequence is used all the time.#Chords #EdSheeran #Music #Songwriting #FediArt #MastoArt https://www.bbc.co.uk/news/world-us-canada-65420696

@simon What are you even talking about? You can't copyright a chord progression šŸ¤¦ā€ā™€ļø These cases are proven (or not) on closeness of one * melody * to another.Sometimes (much rarer) it can be decided on the arrangement rather than the melody.

@simon well if the estate/hedge fund wins then surely it’s open season for writs from anyone who used the sequence prior the Marvin. It would be funny if their greed turned into their downfall…

@essjay Watch the video. Apparently this is what the trail is all about. Not the melody but the chords and hence my comment 😬

@simon I like how they try to claim some moral high ground by ā€˜protecting his legacy’. When it’s actually just a whole heap of free money.

@simon a lot of songs sound like other songs. Tom Petty used to say this, Chuck Berry said this....

@simon Ahh, OK I see where you are coming from here.I think (I'm not an IP lawyer) that the BBC guy has missed the point and is over simplifying the crux of the case.BBC are not renowned for being 'factual' these days.I suspect the Marvin Gaye's estate are going for copyright on 'voice leading' (which can be copyrighted - see linked article).i.e. the progression of chords in this case implies a (very simple) melody of root, third, fourth, fifth.https://support.easysong.com/hc/en-us/articles/1500009595681-What-Parts-of-Music-Can-Be-Copyrighted-and-What-Can-t-

@simon 2/I agree with you though. If they win on that basis it would be ridiculous.I'd be surprised if they did win, as I believe it would leave them open to plagiarism action against 'Let's Get It On' šŸ˜‰ I mean there must be a lot of songs from the 1950's which use a I, vi, IV, V chord progression with a 'leading voice' that imply exactly the same melody. And they got 'Blurred Lines' on a very tenuous 'arrangement' copyright IMO.

@essjay Correct. Not just 50s and 60s though. There would be a tsunami of claims from all ears - it’s totally outrageous as the progression is common as muck, as my grandma would have said.

@simon Which is the very reason that a chord progression per se can't be copyrighted.

@simon Utterly agree, and the case is not being brought my musicians, but but money-grabbing losers who couldn't even put a chord progression together

Yes but if you are good with composing a melody over something millions have heard already, and trotting that out as your own - not much of an artist.#EdSheeran #news@simon https://mastodon.online/@simon@toot.supertonerecords.com/110281910199329272

@Balkingpoints It’s pretty difficult writing something totally original now as all the good sounding changes and structures have been pretty much explored. This is a game changing case.

Then the artform is dead, or reserved to those few who can - still - compose original progressions. Backbone of any song.@simon https://mastodon.online/@simon@toot.supertonerecords.com/110315068931172715

@selzero I don’t know about that, but the case is settled now - in his favour thank fuck. Here it was the principle of a chord sequence, not a top line.
