As we are approaching indictments (imminently!) people are asking how an arrest will happen. Each situation is handled different, and prosecutors have a lot of discretion. A violent crime in progress, for example, will be handled differently from a person who cheated two years ago on taxes.The arrest of a violent crime in progress will, of course, be dramatic.If prosecutors feel there is a danger of destroyed evidence or flight, they can seal the charges and get a warrant.1/

That takes the defendant by surprise so that evidence can be preserved.If the prosecution has been in discussions with the defense lawyer and the prosecutor believes it can be accomplished without a hitch, the defendant, through his or her lawyer, will be given a summons and his or her appearance will be arranged. @Teri_Kanefield There was a discussion on MSNBC about whether or not Republican governors, like De Santis, will give permission for the Feds to make an arrest in FL.(Of course he will.)But doesn't tRump have a Secret Service detachment protecting him? Don't they work for DOJ? Why can't his SS guards be ordered to bring him in?

@Teri_Kanefield Oy; I’m the weak link in my study group.🤪But I have a question - do you think Bragg might have iced the Pomerantz investigation from going to indictment so he could save it to use as a felony enhancement in the Stormy case? Since I’m only 1/2 way through Twitter Law School I have no idea if that could actually be a thing.

@Teri_Kanefield To put some more details on how the "appearance will be arranged": In my experience, the prosecutor contacts defense counsel (and Mag. Judge), and a date is agreed to. The defendant comes to the FBI field office (or Marshal's office) on that day/time, and is photographed and fingerprinted. Law enforcement then brings them to the Mag. Judge's court for the initial appearance (where their lawyer meets them). Arraignment may happen at same time. (Practice may vary by district)
