       I had an ongoing private argument with a well known lawyer on Twitter (who I will not name) in 2021. This person insisted that Garland needed to account to the "public" about what he was doing.I argued that the public should not decide. As I read the Georgia legislation, it is more about forcing prosecutors to bring cases they don't want to bring.It sets up an oversight commission.3/

       The version I read allowed a prosecutor to be removed or retired early for cause.So they can remove a prosecutor.Let's take a worst case scenario:Oversight commissions take time. Let's say 6 months from now Willis has brought charges, so the case is proceeding, and the oversight commission removes her.Well, then another prosecutor in her office takes over. I don't see a provision that allows the legislation to appoint their own person. 4/

       So the prosecution would continue someone from Willis's office leading the case instead of Willis. So the case would continue along with a huge scandal: A GOP led legislature has now stepped in to protect Trump.Remember, Georgia is a state that voted for Biden. Even most Republicans there don't like Trump.I don't see them ending the prosecution. I see them setting off a political bombshell. 5/

       @Teri_Kanefield Agreed. Like a lot of "conservative" state-level legislation these days, it seems to be "show legislation" passed for the purpose of setting up the signing ceremony. Many prosecutors are pre-politicians and they are not going to be cowed by the threat of a legislative inquisition.

       @Teri_Kanefield So, isn't one of the reasons that prosecutors are the decision makers on prosecuting is because they know all the info involved, which is not knowable, especially in a legal context, by the public, and presumably legislators? Can this compel or pressure a prosecutor to bring a case that doesn't have merit, and will be dismissed? Which would prove the prosecutor's point but mess up his holy win percentage?

       @SueShannon Exactly. That is the problem. But this does not prevent people from saying, "We know he's guilty! We have seen the evidence on the Internet!"The thing about being a prosecutor is that you will always have people who hate your decisions. Prosecute and people will hate. Don't prosecute and other people will hate.As a defense lawyer I was usually disgusted with the decisions prosecutors made.

A few days ago I posted links to a few articles describing all these lawsuits being filed against the state of Florida & DeSantis over the various legislation they"ve passed. I believe there's at least 4 and counting. TN is in the process of being sued over the anti-Trans law. I mean, these states are just getting sued left & right, but I wonder if that isn't the whole idea. I assume they're hoping to get conservative judges that will side with them. Then with the conservative SCOTUS, it's a real question mark what exactly will happen with these cases.

People seem to appreciate the more intentional nature of the environment. Twitter exists in a controlled state to force that loopback. On here, one might follow you, and even looking at their account - but the odds of seeing those 'rage bait' accounts are really low. I think the low-engaging bullhorn people will die off naturally?        @dconklin Good point. Whenever I criticized someone, I took a screenshot and removed their name. When I was agreeing, I just did a quote tweet. That way I would not invite a pile on.But once in a while people misunderstood me (or I wasn't clear) and they thought I was criticizing someone I was quote tweeting and there was a pile on.I immediately deleted and apologized to the person.It can easily be used to invite pile ons.

I sincerely hope that "next year" won't have tRUmp's indictments still at issue.Yes, when going for the king you can't miss. If the king were to be re-crowned, it's a miss.        @failedLyndonLaRouchite the 'evidence' that he is in the bag appears to be that (1) we are not seeing the indictment they want or (2) the "experts" found evidence that Obama's team that vetted Garland for a SCOTUS nomination and Biden's team that vetted Garland for AG missed.I know how it feels to be frustrated with the decisions made by prosecutors. I was often frustrated as a defense lawyer.There are definitely bad prosecutors out there, but no real evidence that Garland is "in the bag"

I'm in the Philly area, and the state legislator is trying to recall the Philly DA  - Krassner is not my DA, but he was recently re-elected by the citizens of Philadelphia. The state legislators think they know better.

The election run up on fox news was screaming about weakness on crime, whether it exists or not.I have much more anxiety that some of the people pushing this were part of the false electors scheme.        @Teri_Kanefield Hard to say.  Probably more so from mainstream media.  I mostly watch MSNBC.  I watch Ari and Rachel mostly. They haven’t come out and directly said this was a ploy to protect 45 but they do sort of leave it hanging there.  The timing of this legislation is interesting as well to me.  The Why now? question is key given that laws already exist that permit the removal of DA’s.  Just not easily.   Shouldn’t be easy.  To your point, it’s a power grab.

       @Teri_Kanefield I was concerned until I read your earlier posts, which were the first I happened to catch that actually described the changes.  I think it’s possible this (maybe in combination with some other effort I’ve missed) could be used to prevent the current investigation from going to prosecution, but to be concerned again I’d need a similar description of a plausible path to that, which I have seen so far

Last week a YouTube channel I've followed for years now made some claims about a different law in a different state being pushed by a Republican. The host of the channel was basically saying that the proposed law would end free expression in America. After doing my own digging I found out that the law never made it out of committe and was also opposed by the states governor.........

       @Teri_Kanefield I’m thinking that the GA leg is doing a political thing with potential authoritarian consequences.  The leg is Republican -dominated due to gerrymandering and they wish to retain power in a blue tending state.  With this commission, they may not alter ongoing prosecutions but they can put a damper on future ones.  Prosecutors may worry ā€œIf I prosecute XYZ then the commission will come after me.ā€ So the goal may be for the leg to grab power while it can.

       @Teri_Kanefield I posted a link to an article by a couple lawyers on another platform that was mostly about the effect it could have on Willis, but someone in Georgia said she thought it was mostly about Deborah Gonzalez in Athens, referencing local rivalry and politics, and that Gaines is a sponsor of the bill. I also shared the thread from Anna Bower which mentions this a little, but the comment and links she provided gave me more context for the history of the bill(s) and changing support.

       @PhoenixMe I disagree with her about the 'hard to hold prosecutors to account.'I prosecutor who withholds or falsifies evidence will give a defense counsel a heyday. The defendants will all get off scot free if the defense can show that this happened.Prosecutors who are elected can be voted out of office.At the same time prosecutors should not be "held to account" for not doing what we want them to do.As it turns out, I'm writing about that this weekend.        @Teri_Kanefield It absolutely is, and it’s why I follow you! šŸ˜‰ I worked as a psychologist before a medical condition forced me to give it up, so criminal law is both foreign and fascinating for me, for the reasons you mentioned, but also for its role as a democratic institution and its frightening potential to be weaponised.
